General Conditions
1. This permit is issued by the North Carolina Department of Environment and Natural
Resources, Division of Waste Management, Solid Waste Section (Section). In accordance
with North Carolina Solid Waste Management Rule 15A NCAC 13B .0201(d), a solid waste
management facility permit shall have two parts: a Permit to Construct and a Permit to
Operate. The Permit to Construct must be implemented in accordance with Attachment 2 of
this permit. The Permit to Operate must be implemented in accordance with Attachment 3 of
this permit.
2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the
solid waste management facility.
3. The permit shall not be effective until the certified copy of this permit which shows current
ownership and references legal descriptions for all land within the solid waste management
facility boundary is recorded in the Register of Deeds office and indexed in the grantor index
under the name of the owner of the land in the county or counties in which the land is
located. The certified copy of the permit affixed with the Register's seal and the date, book,
and page number of recording must be returned to the Section within 30 calendar days of
issuance of this permit. If the Section does not receive the certified copy of the recorded
permit within 30 calendar days of issuance of the permit, then and in that event, the permit is
suspended and of no effect until the date the Section receives the certified copy of the
recorded permit.
4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other
instrument of transfer shall contain in the description section in no smaller type than that
used in the body of the deed or instrument, a statement that the property has been used as a
solid waste management facility and a reference by book and page to the recordation of the
permit.
5. By receiving waste at this facility the permittee shall be considered to have accepted the
terms and conditions of this permit.
6. Operation of this solid waste management facility shall be in accordance with the Solid
Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North
Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit;
and the approved plan. Should the approved plan and the rules conflict, the Solid Waste

Management Rules shall take precedence unless specifically addressed by permit condition.
Failure to comply may result in compliance action or permit revocation.
7. This permit is issued based on the documents submitted in support of the application for
permitting the facility including those identified in Attachment 1, “List of Documents for
Approved Plan,” and which constitute the approved plan for the facility. Where
discrepancies exist, the most recent submittals and the Conditions of Permit shall govern.
8. This permit may be transferred only with the approval of the Section, through the issuance of
a new or substantially amended permit in accordance with applicable statutes and rules. In
accordance with NCGS 130A-295.2(g) the permittee must notify the Section thirty (30) days
prior to any significant change in the identity or business structure of either the owner or the
operator, including but not limited to a proposed transfer of ownership of the facility or a
change in the parent company of the owner or operator of the facility.
9. The permittee is responsible for obtaining all permits and approvals necessary for the
development of this project including approval from appropriate agencies for a General or
Individual NPDES Stormwater Discharge Permit. Issuance of this permit does not remove
the permittee’s responsibilities for compliance with any other local, state or federal rule,
regulation or statute.

CONDITIONS OF PERMIT TO OPERATE
PART I: GENERAL FACILITY
1. All sedimentation and erosion control activities must be conducted in accordance with the
Sedimentation Control Act NCGS 113A-50, et seq., and rules promulgated under 15A
NCAC 4. All required sedimentation and erosion control measures must be installed and
operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the
landfill unit during the service life of the facility.
2. Facility construction, operations or practices must not cause or result in a discharge of
pollution, dredged material, and/or fill material into waters of the state in violation of the
requirements under Sections 401 and 404 of the Clean Water Act, as amended.
3. Copies of this permit, the approved plans, and all records required to be maintained in the
operating record by the permittee must be maintained at the facility, unless otherwise
approved by the Section, and made available to the Section upon request during normal
business hours.
4. All forms, reports, maps, plans, and data submitted to the Section must include an electronic
(pdf) copy.
5. Open burning of solid waste is prohibited. Fires must be reported to the Regional Waste
Management Specialist within twenty-four (24) hours of the occurrence with a written
notification to be submitted within fifteen (15) calendar days of the occurrence. Fire lanes
must be maintained and passable at all times. Dimensions of the fire lanes must be
coordinated with the Fire Marshall having jurisdiction over the site.
6. Processing of materials, shredding, or grinding must not take place at the facility unless
approval has been granted under the special use permit and a revised operations plan has
been submitted to the Solid Waste Section.
7. The facility must be adequately secured by means of gates, chains, berms, fences, or other
security measures approved by the Section to prevent unauthorized entry.
8. Signs must be posted at the entrance to the facility that state that no hazardous waste or liquid
waste can be received at the facility; and that provide information on dumping procedures,
the hours of operation, the permit number, and other pertinent information. Traffic signs or
markers must be provided as necessary to promote an orderly traffic pattern to and from the
discharge area and to maintain efficient operating conditions.

General Conditions
9. The permittee must maintain a record of the amount of solid waste received at the facility,
including daily records of waste received and origins of the loads. The daily records are to
be summarized into a monthly report for use in the required annual reports.
10. This facility shall conform to all operating procedures in the approved plan, 15A NCAC 13B
.0400 and in the Guidance Document for HHW Facilities (proposed Rule .1807, Operational
Requirements, proposed Rule .1808, Closure Requirements, and proposed Rule .1809
Transportation From Temporary and Permanent Collection Facilities To Treatment, Storage,
Disposal, Or Recycling Facilities).
11. The permittee must develop, and use, a training and screening program at the facility for
detecting and preventing unauthorized wastes from being accepted at the facility.
12. A responsible individual trained and certified in facility operations must be on-site at all
times during all operating hours of the facility, in accordance with G.S. 130A-309.25.
13. Only personnel who have been trained in accordance with the approved training program in
the Operation Plan (Attachment 1) shall participate in collection activities.
14. Facility personnel shall inspect the facility's emergency equipment and supplies on a weekly
basis. Adequate amounts of absorbent material shall be maintained on-site to clean up spills
or leaks of small quantities.
15. The facility shall have adequate secondary containment system in the storage area that can
contain any HHW discharges, leaks, or spills, for at least forty-eight (48) hours before
detection and removal.
16. Sump outlets in the HHW collection building shall remain plugged and closed.
17. Materials shall be stored in the HHW collection facility so as to not obstruct the movement of
personnel, fire protection equipment, spill control equipment, and decontamination
equipment during an emergency.
18. Containers shall be managed so as to prevent leaks. Containers shall be thoroughly rinsed
after emptying to ensure incompatible materials are not mixed.
19. The date upon which each period of accumulation begins shall be clearly marked and visible
on each container. Each container shall be labeled or marked clearly with the words
"Hazardous Waste" unless the container separately holds recyclable material. The maximum

period of accumulation for all HHW stored at the facility shall be no more than 180 days
after initial receipt. Before the end of 180 days, the HHW shall be transported off-site for
recycling, treatment and/or disposal.
20. Collected HHW shall be shipped off-site by a licensed hazardous waste contractor to a
licensed hazardous waste facility for recycling, treatment, and/or disposal.
21. In the unlikely event of an incident which threatens human health or the environment outside
the facility boundary and/or which results in halting operations at the facility, the Emergency
Response Coordinator shall implement the approved Contingency Plan (Attachment Ill). At a
minimum, the Emergency Response Coordinator shall:
a. Immediately notify the Mecklenburg County Emergency Management Service.
b. Notify the Solid Waste Section's Waste Management Specialist in the Mooresville
Regional Office at (704) 633-1699 within 24 hours of the incident.
c. Identify the character, source, and amount of all released hazardous materials.
d. Assess the possible hazards to human health and the environment.
e. Ensure that, in the affected areas of the facility:
i) no waste that may be incompatible with the released material is stored until cleanup
procedures are completed, and;
ii) all emergency equipment is cleaned and fit for its intended use before operations are
resumed.
f. Note in the operating record the time, date, and details of the incident.
g. Submit a written report detailing the incident to the Solid Waste Section within 15 days
of the incident.
Specific Conditions
22. The Permit to Operate shall expire June 2, 2021. Pursuant to 15A NCAC 13B .0201(g), no
later than December 2, 2020 (6 months prior to expiration), the owner or operator must
submit a request to the Section for permit review and must update pertinent facility plans
including, but not limited to, the facility operation plan.
23. This facility is permitted to receive Household Hazardous Waste (HHW) generated within
Mecklenburg County. To qualify as HHW the waste must be:
a. Generated by individuals on the premises of a residence for individuals (a household),
and;
b. Composed primarily of materials found in the wastes generated by consumers in their
homes.
24. Household Hazardous Waste Generator Identification Number NCPH0609801 shall be used
to ship wastes off site for recycling, treatment, or disposal.
25. On or before August 1 annually, the Permittee must submit an annual facility report to the
Solid Waste Section, on forms prescribed by the Section.
a. The reporting period shall be for the previous year beginning July 1 and ending June 30.

b. The annual facility report must list the amount of waste received and be compiled:
i) On a monthly basis.
ii) By county or city of origin.
iii) By specific waste type.
iv) By receiving disposal facility.
v) By diversion to alternative management facilities.
c. The completed report must be forwarded to the Regional Environmental Specialist for the
facility by the date due on the prescribed annual facility report form.
d. A copy of the completed report must be forwarded to each county manager for each
county from which waste was received the facility. Documentation that a copy of the
report has been forwarded to the county managers must be sent to the Regional
Environmental Specialist by the date due on the prescribed annual facility report form.
PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT
General Conditions
26. A responsible individual trained and certified in facility operations must be on-site at all
times during all operating hours of the facility, in accordance with G.S. 130A-309.25.
27. The permittee must develop, and use, a training and screening program at the facility for
detecting and preventing unauthorized wastes from being accepted at the facility. At a
minimum, the program must include:
a. Random inspections of incoming loads or other comparable procedures.
b. Records of all inspections.
c. Training of personnel to recognize hazardous, liquid and other excluded waste types.
28. The facility must not cause nuisance conditions.
a. Effective vector control measures must be applied at all times to control any potential
vectors including flies, rodents, insects, and other vermin.
b. Control measures must be utilized to minimize and eliminate visible dust emissions and
blowing litter.
i) Fugitive dust emissions are prohibited.
ii) Windblown materials must be collected by the end of the day and no windblown
material may be allowed to leave the facility boundary.
c. Areas shall be operated and maintained in a manner so as to minimize odors.
29. Surface water shall be diverted from all operational and storage areas to prevent standing
water in operational areas and under or around storage piles. Water that comes in contact
with solid waste shall be contained on-site or properly treated prior to discharge.
30. Wastes received and product stored shall be maintained in containers or reasonably sized
piles with adequate fire breaks and lanes in accordance with the approved operational plans
and the pertinent rules.

c. The total quantity in cubic yards and type of waste received at the facility during the
reporting year;
d. The total quantity in cubic yards and type of waste processed at the facility during the
reporting year;
e. The total quantity in cubic yards and type of material produced at the facility during the
reporting year;
f. The total quantity in cubic yards and type of material removed for use or disposal from
the facility, along with a description of the market use, for the facility during the
reporting year;
g. The completed report must be forwarded the Section.
Operational Conditions – Treatment & Processing (Grinding Operation)
35. The facility has a total permitted gross capacity of 10,000 cubic yards of permitted materials.
36. The facility is permitted to operate a treatment and processing facility as defined in 15A
NCAC 13B, Rule .0101(49).
37. The facility is permitted to receive the following materials:
a. land clearing waste as defined in 15A NCAC 13B, Rule .0101(23);
b. yard waste as defined in 15A NCAC 13B, Rule .0101(56);
c. unpainted and untreated natural wood;
d. wooden pallets constructed of unpainted and untreated natural wood;
38. Only materials specifically listed in the permit application may be managed at this facility
without adequate testing and prior approval of the Division of Waste Management. Should
materials begin to compost, generate heat in excess of 110 degrees Fahrenheit, resulting in a
change in physical appearance of the ground material, it will be necessary to compost the
material at a permitted operation.

39. The facility must manage the treatment and processing according to the Operation Plan
included in Attachment 1. This document is included in the approved plan. Any revisions to
the approved plan shall be approved by the Section, prior to implementation.
