The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENT
1. The facility is a scrap tire collection facility. Killy’s Tires’ Hauler ID number is NCT02004.
2. Hours of operation are 8am to 5pm. The facility is properly secured. Personnel are on site during operating
hours.
3. The facility permit expired July 21, 2015. A Permit renewal application should have been submitted to
the SWS by January 21, 2015. Please resubmit the permit renewal application immediately to Ed
Mussler, Permitting Branch Head, electronically at ed.mussler@ncdenr.gov or by mail to Division of
Waste Management, Solid Waste Section, 1646 Mail Service Center, NC 27699-1649.
4. The facility collects only reusable scrap tires (via contract) from the North Carolina Department of Public
Instruction and the North Carolina State High Patrol. The facility is permitted to receive scrap tires from all 100
counties.
5. The facility site plan and operations plan were discussed.
6. Scrap tires are stored in a warehouse and primarily shipped, via overseas container, to Panama. Some scrap tires
are shipped to a distributor within the US. Scrap tires are loaded for shipment while the driver is on site
(containers and trailers are not stored on site).
7. Two fire extinguishers are available for fire suppression. The facility does not have an automatic sprinkler system.
The local fire department will provide fire control. The fire department has regulated that stored scrap tires must
not exceed 6 feet in height and must be a minimum of 2 feet from walls. Dimension requirements are marked with
orange tape.
8. Unusable scrap tires are not intentionally collected however, occasionally they are mixed-in with usable scrap
tires. Unwanted scrap tires are brought to local scrap tire collection facilities within the county where the tires
originated. A small trailer was observed during the inspection containing tires for disposal.
9. The facility annual report for FY2014-2015 indicated that the facility processed 3,347.05 tons of tires during that
time period.
10. The facility is permitted to store a maximum of 300 scrap tires onsite at any time. All tires onsite are stored
within the building and the facility is being maintained in a neat and orderly manner.
