Summers and Son Landfill (via phone 05/2716) STATUS OF PERMIT: Land Clearing and Inert Debris Landfill Notification recorded with the Guilford County Register of Deeds November 14, 2000 Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On May 27, 2016, John Patrone met with Clarence Summers, Sr. to conduct a comprehensive inspection of the C.L. Summers and Son Landfill – LCID Landfill on Wagoner Road in Gibsonville, Guilford County. 1. The C.L. Summers and Son Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The landfill is known as Summers LCID Landfill, Inc. 3. The LCID landfill is < 2 acres. Mr. Patrone was given a copy of a statement from Allred Land Surveying PLLC stating that the landfill, per edge of waste markers installed by the facility, is 1.98 acres (see attached). 4. The LCID landfill is primarily used by Clarence L. Summers and Son Trucking and Grading, Inc. but is open to the general public. 5. The LCID landfill is operated by Clarence Summers, Jr. 6. The facility removes logs from land clearing debris (LCD) and stores them separately to cut for firewood. 7. Reusable concrete items are stored along the access road. 8. Mr. Summers, Jr. stated that LCD on site has been received in recent days. 9. Mr. Summers, Jr. will construct a stormwater runoff channel from atop the right side of the landfill, along the external side slope, to the stormwater pond. He was reminded that the LCD must be covered with soil prior to creating the channel or installing a conduit along the area. 10. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 11. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 12. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 13. It has been stated that the older portion of the landfill contains only soil and that the side slopes, of the soil area, contain inert materials for stabilization. 14. The facility has an all-weather access road. 15. The facility has a proper sign. It is suggested that the facility identification number is posted: N0550. 16. The facility is also a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS41-005. It is suggested that the identification number is posted.
