HomeMy WebLinkAboutSDTF7904_INSP_20160414FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 1 of 3 UNIT TYPE: Lined MSWLF LCID YW Transfer Compost SLAS COUNTY: Rockingham Closed MSWLF HHW White goods Incin T&P FIRM PERMIT NO.: SDTF-79-04 CDLF Tire T&P / Collection Tire Monofill Industrial Landfill DEMO SDTF X FILE TYPE: COMPLIANCE Date of Site Inspection: April 14, 2016 Date of Last Inspection: September 16, 2015 FACILITY NAME AND ADDRESS: Gann Brothers Septic Tank Service, Inc. 367 Case Road Madison, North Carolina 27025 GPS COORDINATES: N: 36.40728° W: 80.01980° FACILITY CONTACT NAME AND PHONE NUMBER: Name: Patrick & Eric Gann Telephone: (336) 548-2971 Cell Phone (Eric Gann): (336) 520-8680 Email address: gann.brothers@yahoo.com FACILITY CONTACT ADDRESS: 191 Percy Lane Mayodan, North Carolina 27027 PARTICIPANTS: Troy Harrison, Solid Waste Section STATUS OF PERMIT: Active Issued: December 31, 2014 Expires: December 31, 2019 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0841 (c) states: “Septage treatment and detention facility containers shall be structurally sound and constructed of steel, concrete, or fiberglass.” On September 16, 2015, Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0841 (c) because a 15,000 gallon tank (located on the left from the road) was observed with several holes that ran along the welding seams. 15A NCAC 13B .0841 (e) states in part: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;” In order to come into compliance, Gann Brothers Septic Tank Service, Inc. was required to immediately cease use of and remove all waste from the 15,000 gallon tank. On April 14, 2016, it was confirmed that the 15,000 gallon tank had been emptied and taken out of service. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0841 (e) states in part: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;” Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0841 (e) because septage was observed ponding at the rear of the 15,000 gallon tank. 2. North Carolina Solid Waste Permit Number SDTF-79-04 “Conditions of Operating Permit” Number 2 states: “Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up and treated to prevent any contamination of the surrounding area.” Gann Brothers Septic Tank Service, Inc. was in violation of North Carolina Solid Waste Permit Number SDTF- 79-04 “Conditions of Operating Permit” Number 2 because the septage leak was not immediately contained, cleaned up or treated. ADDITIONAL COMMENTS 1. The Septage Detention and Treatment facility (SDTF) consisted of two 15,000 gallon and one 10,000 gallon above ground gravity fed tanks for storage and treatment of domestic septage and grease trap pumping. 2. All photographs were taken by Troy Harrison on April 14, 2016. 3. Set-back/buffer requirements appear to have been met. 4. Appropriate signage (No Trespassing signs) is posted for the site. 5. All weather roads are maintained for access to the site. 6. The 10,000 Tank appeared to be structurally sound with no leaks or odors observed. 7. On September 16, 2015, the 15,000 tank located on the right (looking from the access road) was observed with several holes that ran along the welding seams. Septage was not observed flowing from the holes and it appears that this tank in no longer in use. 8. The 15,000 tank located on the left (looking form the access road) was observed with septage ponded at the bottom of the tank. Septage odors were observed in this area. Vegetation immediately below the tank was noticeably thicker and greener in the direction of the slope. No leaks from the top or sides were observed. The leak appeared to be coming from the bottom of the tank. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
