STATUS OF PERMIT: Active Issued: August 8, 2012 Expires: August 8, 2017 PURPOSE OF SITE VISIT: Follow-up Inspection STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0838 (a)(18) states: Approved nutrient management plans shall be followed. Permit number SLAS-79-06/Conditions of Operating Permit Section two states in part: This site shall be operated and maintained in accordance with the nutrient management plan submitted by Patrick and Eric Gann and approved by the Division of Waste Management. Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0838 (a)(7) because the approved Nutrient Management Plan (Plan) Section B paragraph 2 states in part: “In order for this fescue field to receive septage, a 80% stand should be maintained”. Field 2 appeared to have less than 80% coverage of fescue. The other vegetation was either dormant, dead or damaged at the time of inspection. In order to come into compliance, Gann Brothers Septic Tank Service, Inc. must immediately either follow the Plan for SLAS-79-04 or change the Plan to reflect the bermuda grass. If another cropping system other than fescue be desired or recommended, a revised Plan, written by a certified technical specialist, reflecting the change must be submitted. Contact Connie Wylie at connie.wylie@ncdenr.gov or 910-433-3352 to update the Plan. This violation is not yet resolved. OBSERVED VIOLATIONS: See past noted violations ADDITIONAL COMMENTS 1. The Septage Land Application Site consists of Field 1 (5.8 acres) and Field 2 (5.6 acres). 2. The site is permitted for land application of domestic septage and grease septage. 3. The site is located at 367 Case Road and has accessible all-weather roads to the septage land application field covered under the permit. 4. Appropriate signage was displayed at the site. 5. Disposal area boundaries were delineated with permanent markers. New markers had been placed at the southwest and northeast corners of Field 2 and northeast corner of Field 1, which were missing during the previous inspection. 6. It appears that no new applications have been made recently. 7. Dead, damaged or dormant areas & vegetation other than fescue was observed in Field 2. The need for a revised Nutrient Management Plan (Plan) was discussed. Both fields were initially permitted to have tall fescue as a cover crop. However, it appears that Field 2 has much less than 80% cover of fescue with the rest being bermuda grass and various weeds. The Plan must be immediately followed or revised to reflect the bermuda grass. Failure to follow or update the plan could result in incurring violations with civil penalties. You can also contact the Rockingham County Cooperative Extension at 336-342-8230 for advice on field maintenance and weed control. The possibility of a future company ownership or landowner change was also discussed in which a “Landowner’s Authorization” may need to be submitted. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
