STATUS OF PAST NOTED VIOLATIONS:
1. 15A NCAC 13B .0841 (e) states in part: “Each detention and treatment facility shall be designed, constructed,
and maintained in such a manner as to:
(1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground
surface, or into any surface waters;”
On April 14, 2016, Gann Brothers Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0841 (e)
because septage was observed ponding at the rear of the 15,000 gallon tank.
On April 21, it was observed that the tank had been emptied. The violation is resolved.
2. North Carolina Solid Waste Permit Number SDTF-79-04 “Conditions of Operating Permit” Number 2 states:
“Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up and
treated to prevent any contamination of the surrounding area.”

On April 14, 2016, Gann Brothers Septic Tank Service, Inc. was in violation of North Carolina Solid Waste
Permit Number SDTF-79-04 “Conditions of Operating Permit” Number 2 because the septage leak was not
immediately contained, cleaned up or treated.
On April 21, 2016 it was observed that the leaking tank had been emptied and lime applied the area below
the tank. The violation is resolved.
OBSERVED VIOLATIONS:

ADDITIONAL COMMENTS
1. The Septage Detention and Treatment facility (SDTF) consisted of two 15,000 gallon and one 10,000 gallon
above ground gravity fed tanks for storage and treatment of domestic septage and grease trap pumping.
2. Set-back/buffer requirements appear to have been met.
3. Appropriate signage (No Trespassing signs) is posted for the site.
4. All weather roads are maintained for access to the site.
5. The 10,000 Tank appeared to be structurally sound with no leaks or odors observed.
6. During previous inspections, the 15,000 tank located on the right (looking from the access road) was observed
with several holes that ran along the welding seams. It appears that this tank in no longer in use.
7. The 15,000 tank located on the left (looking from the access road) that was observed with septage ponded at the
bottom of the tank on April 14, 2016 appears to have been drained. The area below the tank was dry and lime
applied.
8. Mr. Gann stated that they want to get concrete tanks as replacements for the two unusable steel tanks. A permit
modification will be required since this is not a “like-for-like change.
9. The possibility of a future company ownership or landowner change was also discussed in which a
“Landowner’s Authorization” may need to be submitted.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
