These include, but not limited to, fruits, vegetables, and tobacco.” On September 16, 2015, Billingsley Septic Tank Company (the company) was in violation of 15A NCAC 13B .0837(d)(11) because There was a tobacco crop on a neighboring field to the north of Field 5a with a buffer that was measured to be 20 feet. In order to come into compliance, the company was required to adjust either the septage application field boundary or tobacco field boundary to allow for a 50 foot buffer between the two fields. This had been done. The violations is resolved. OBSERVED VIOLATIONS: N/A FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. All photographs were taken by Troy Harrison on April 14, 2016. 2. The Septage Land Application Site consists of four fields totaling approximately 30.17acres. Field 5A contains 8.01 acres, Field 5B contains 4.88 acres, Field 6A contains 9.74 acres and Field 6B contains 7.54 acres. 3. The site is permitted for land application of domestic septage and grease septage. 4. The site is located at the end of Penn Road and has accessible all-weather roads to the site and septage land application fields covered under the permit. 5. Appropriate signage was displayed at the site. 6. Disposal area boundaries delineated with permanent markers. On the west side of field 6a, the pond was full and there was not a 100 foot buffer to the pond. The boundary markers will need to be adjusted so that when the pond is full the 100 foot buffer is maintained. 7. The tobacco crop that was noted during the 9/16/2015 inspection has been harvested. It also appears that the tobacco field has been marked so that the next crop will be outside of the 50 foot buffer. 8. All septage discharges appear to have been made within the disposal area boundary. Fields 5a and 6a were not in use. The most recent applications appeared to be in Field 5a. 9. There is no evidence of standing liquid or pooled waste. The waste appeared to be evenly distributed throughout the field. 10. No objectionable odors were observed. 11. Field 5b and 6b had been tilled. As a reminder, Fields cannot be used for land application unless an adequate fescue crop is established and maintained. In addition, the approved Nutrient Management Plan contained in your permit has fescue as the cover crop for all four fields. Planting of cover crops other than fescue is not approved in the current Nutrient Management Plan. You can also contact the Rockingham County Cooperative Extension at 336-342-8230 for advice on field maintenance and weed control. Field 6b Field 5a (foreground) and 5b (background) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
