North Carolina Solid Waste Permit SDTF-34-05, Operating Permit Condition #3 states in part: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g)”. Carolina Resource Recovery for Liberation Capital BG Winston-Salem, LLC was in violation of A NCAC 13B .0841(g) and North Carolina Solid Waste Permit SDTF-34-05, Operating Condition #3 because odors were observed by Forsyth County Office of Environmental Assistance Staff between 9:10 AM and 9:15 AM near the entrance to the facility on Palmer Road and at City of Winston-Salem Fire Station No. 5 located at 771 Palmer Lane on May 24, 2016. On May 24, 2016, at 8:04 AM a complaint was received from Mr. Shawn Harber, Fire Captain, City of Winston-Salem via telephone concerning Carolina Resource Recovery (CRR). He stated that the smell was terrible this morning. 2. I contacted Matthew Brickey, Environmental Senior Specialist with Forsyth County Environmental Assistance (Forsyth County) who conducted an investigation. He later called me back and stated that odors were observed at the Fire Station No. 5 located at 771 Palmer Lane and stronger on Palmer Lane next to CRR between 9:10 AM and 9:15 AM. Mr. Brickey also met with personnel at CRR who stated that operation was normal with one truck being off-loaded at 6:00 AM. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
