On November 10,2015,B &M Septic Tank.Inc.was in violation of 15A NCAC 13B .0838 (a)(3)because the access road was rutted and impassable. On April 21,2016,the road was observed to have been repaired.The violation is resolved. 2.15A NCAC 13B .0838 (a)(18)states:“Approved nutrient management plans shall be followed”. On November 10,2015,B &M Septic Tank.Inc.was in violation of 15A NCAC 13B .0838 (a)(18)because the nutrient management plan for SLAS-85-11 states;“Routine maintenance and cropping practices will be needed to maintain stand of fescue.”Field No.1 was damaged due do vehicle ruts and heavy application. On April 21,2016,repairs were observed to be in progress to Field 1.The violation is resolved. Routine Connie Wylie, NC Solid Waste Section N: 36.52618 W: 80.08714 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section ADDITIONAL COMMENTS The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. OBSERVED VIOLATIONS: 1.All photographs were taken by Troy Harrison on April 21,2016. 2.The Septage Land Application Site (site)consists of Field 1 (3.50 acres),Field 2 (3.19 acres)and Field 3 (5.02 acres)for a total of 11.71 usable acres. 3.The site is located at 3639 Beasley School Road,Snow Creek,NC. 4.During the previous inspection,it was observed that the road to the site was rutted and impassable.This has been corrected with repairs to the entrance road. 5.Field disposal area boundaries were well delineated with permanent markers corresponding to the site map.with the exception of several posts that were replaced during the inspection.Several markers were obscured by woody vegetation.The vegetation will need to be removed. 6.All septage discharges appear to have been made within the disposal area boundary. 7.No evidence of standing liquid or pooled waste,however;there were areas of heavy application that appeared to be affecting crop growth.B &M Septic Tank,Inc.staff stated that distribution of the waste has been changed since the last inspection so that certain areas do not overloaded. 8.During the previous inspection,ruts were observed along with standing water that appeared to be from recent heavy rain in Field 1.This was observed to be in the process of being repaired with repairs and recent seeding. 9.During the previous inspection,it was observed that the road to the site was rutted and impassable.This has been corrected with repairs to the entrance road. 10.No objectionable odors were observed.
