Permit to Operate (PTO) Cell 4 issued April 13, 2011, expires November 28, 2016. No later than June 01, 2016. Dare County must send a permit review request must be sent to DWM for cells 1-4 to renew their PTO. An additional Amendment has been sent to DWM for an approval for a Phase 5. This has been approved for PTO and Permit to Construct (PTC) on August 28, 2015 and that permit will expire on February 28, 2017 if substantial construction does not begin within 18 months from the issuance date of this permit; the permittee must obtain a permit modification to construction. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: No violations observed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS: 01 – This Facility is permitted to receive Construction and Demolition (C&D) waste, inert debris, land clearing debris, asphalt. 02 – Cell #4 is currently being operated. 03 – This facility is secured by locked gate at the facility entrance. 04 – The operating hours are Monday – Friday 7:00am to 5:00pm and Saturday 7:00am to 12:00 pm. Holidays observed are New Year’s Day, Thanksgiving Day and Christmas Day. 05 – Facility has proper signage with all required information displayed. 06 – Facility roads are of all-weather construction and overall in good condition. 07 – Facility monitoring wells observed and appear to be maintained. Monitoring Well #6 was unlocked. Be sure to lock all well heads. Environ 1 contracts the monitoring of wells. New locks have been ordered for wells. 08 – The working face is limited to a small area (¼ acre) with cover added during this inspection. Screening of the loads dumped are being done. Any non C&D waste pulled out of the C&D working face is removed and taken to 28-05T- Transfer Station on-site. Cover material stockpiled close to working cell. 09 – This C&D permitted facility has 3 certified operators: Clyde Gard, expires October 19, 2016. Glen C. Bailey, expires October 19, 2016 and Deborah A. Equils, expires June 21, 2016. 10 – Cell #3 has small area in need of repair on North end at mid-point to the toe of the cell slope. Minor slumping and wet area at toe. 11 – Waste edge markers in place. 12 – Overall, the closed areas of the Landfill appear to be maintained well. 13 – A Comprehensive Facility Compliance Inspection to review all records and landfill footprint will be conducted later in 2016. 14 – Digital Pictures taken during this Partial Facility Compliance Inspection.  Signage and Monitoring well. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
