Dear Mr. Frost,
On October 19, 2015, Duke Energy (Duke) notified the Division that the final placement of coal
combustion product occurred at the Marshall Steam Station FGD Landfill (Permit No. 1804-INDUS).
With that notification, Duke requested deference of closure activities. In a response from the Division
dated October 20, 2015, Duke received approval to defer closure activities.
This letter serves as response to the Division expectations as follows:
2. Within six (6) months utilize temporary seeding to stabilize all areas of the landfill.
3. Notify the Section when each activity (above) is completed.
Response: Seeding was applied in November 2015, since then the area has stabilized and the photos
below show the condition of the FGD Landfill as of April 8, 2016.
Duke Energy is committed to environmental stewardship and cooperation with the Division regarding the
operation, maintenance, safety, and integrity of all of its facilities. We look forward to continuing to work
