Dear Mr. Jimenez:
S&ME, Inc. (S&ME) respectfully submits this Limited Soil Sampling Letter Report for two residential properties
located at 9402 and 9602 Mallard Creek Road in Charlotte, Mecklenburg County, North Carolina (subject
property"). The two residential properties are part of the Mallard Creek Road Assemblage, which is located from
9402 to 9728 Mallard Creek Road in Charlotte. This report was prepared to assess whether the two potential
heating oil underground storage tanks (USTs) are present at the residential properties at 9402 and 9602 Mallard
Creek Road, and to document soil conditions adjacent to the USTs, and if identified, to assess whether a release
may have occurred. The potential presence of the heating oil USTs was identified during a Phase I Environmental
Site Assessment (ESA) conducted by S&ME on the Mallard Creek Road Assemblage. This project was conducted
in general conformance with S&ME Proposal No. 218636C dated January 4, 2023.
Project Background
In December 2022, S&ME completed a Phase I ESA on the Mallard Creek Road Assemblage located from 9402 to
9728 Mallard Creek Road in Charlotte, Mecklenburg County, North Carolina. The Mallard Creek Road Assemblage
contains approximately 13 acres, and it is comprised of nine adjoining Mecklenburg County tax parcels. The
Mallard Creek Road Assemblage is developed with five residences and associated outbuildings. Potential heating
oil UST vent pipes/fill ports were observed at the following residences at the subject property:
9402 Mallard Creek Road — tax parcel 04775215. The property at 9402 Mallard Creek Road is developed
with one single -story, residential structure containing approximately 2,360 square feet (SF) that was
constructed in 1937. The subject property can be accessed from the southwest via an entrance driveway
from Mallard Creek Road.
9602 Mallard Creek Road — tax parcel 04775215. The property at 9602 Mallard Creek Road is developed
with one single -story, residential structure containing approximately 1,306 SF that was constructed in
1952. The subject property can be accessed from the west via an entrance driveway from Mallard Creek
Road.

Potential residential heating oil UST vent/fill pipes were observed on the south side of each of the residences at
9402 and 9602 Mallard Creek Road. The ages and sizes of the potential USTs were not known. The presence of
potential residential heating oil USTs was identified as a recognized environmental condition (REC) with respect to
the Mallard Creek Road Assemblage in S&ME's Phase I ESA Report. A Site Vicinity Map is provided as Figure 1 in
Attachment A.
Based on the Phase I ESA findings, Mr. Daniel Jimenez of Delray at Mallard Creek, LLC (Delray) requested that
S&ME conducted a limited soil assessment at the potential heating oil USTs.
Project Description
S&ME was retained by Delray to complete a limited soil assessment which included the following proposed
assessment scope of work:
If possible based on site conditions, determine the length and diameter of the potential USTs using a
probe rod. In addition, if the tanks are accessible, measure the height of fluid in the tank and calculate
the volume of material based on the tank dimensions. During field activities, the depth to the top and
bottom of the tanks and the depth will also be determined, if the tanks are accessible.
Advance up to three hand auger soil borings on the different sides of the potential heating oil USTs. The
borings will be advanced to approximately one foot below the approximate depth of the bottom or the
tank, if determined, or approximately 7 feet below ground surface (bgs) if the bottom of the tank is not
determined. Soil cuttings from each boring will be field screened with a photoionization detector (PID).
Based on field observations and field screening results, one soil sample will be collected from each boring
for certified laboratory analysis. The collected samples will be submitted to at North Carolina certified
laboratory for analysis for total petroleum hydrocarbons (TPH) gasoline range organics (GRO) and diesel
range organics (DRO) by EPA Method 8015.
Upon receipt of the analytical report, prepare a Limited Soil Sampling Report that details the field
activities and findings of the assessment.
Field Activities
Prior to mobilizing to the subject property, S&ME conducted project management activities to support the soil
assessment. Field activities were performed on January 11, 2023. Field work was conducted by Ms. Laura Beth
Slagle and Mr. Matt Brundage of S&ME.
Project Coordination
S&ME conducted the following project management and coordination work prior to initiating limited soil
assessment field activities at the subject site:
On January 4, 2023, S&ME submitted a North Carolina 811 ticket for utility locating at 9402 and 9602
Mallard Creek Road. Utility locating was completed by January 11, 2023.

S&ME obtained laboratory -provided containers and coolers from Waypoint Analytical (Waypoint) in
Charlotte, North Carolina for the proposed soil sampling activities.
UST Arrangement Assessment
9402 Mallard Creek Road
Upon arrival at 9402 Mallard Creek Road, Mr. Joe Strube, the property owner, informed S&ME that the suspected
potential heating oil UST vent pipe was a grounding rod, and not associated with a UST. Mr. Strube stated that a
heating oil UST was previously located on the east side of the residence at 9402 Mallard Creek Road. He said that
he removed the UST in the 1970's, and a sunroom was constructed over the former UST location.
9602 Mallard Creek Road
S&ME used a metal probe rod to determine the dimensions of the heating oil tank on the south side of the
residential property at 9602 Mallard Creek Road. The probe rod was manually pushed into the ground surface to
determine the length of the tank and the depth to the top of the tank. The tank was accessed via the fill pipe, and
a tape measure was inserted to determine the depth to the bottom of the tank and the height of the fluid in the
tank. The following information was gathered during assessment of the UST arrangement:
The tank is oriented perpendicular to the south side of the house.
♦ The top of the tank is located approximately 15" bgs.
♦ The bottom of the tank is located approximately 59" bgs.
♦ Based on top and bottom measurements, the diameter of the tank is approximately 44".
♦ The length of the tank is approximately 84".
♦ Based on the dimension measurements, the volume of the tank was calculated to be 580 gallons.
♦ Approximately 42" of fluid was measured in the tank. According to the Highland Tank website for tank
gauge charts, the measured volume of fluid in the tank corresponds to approximately 560 gallons.
Soil Sampling
9402 Mallard Creek Road
Soil sampling was not conducted at the grounding rod because the property owner indicated that it was not part
of a UST system. Soil sampling was not conducted in the reported former UST area because the construction of
the sunroom made the location inaccessible.
9602 Mallard Creek Road
Soil sampling activities at the subject property were conducted on January 11, 2023. Two soil borings (SB-1 and
SB-2) were advanced adjacent to the heating oil UST using a decontaminated stainless steel hand auger. Boring
SB-1 was advanced on the south side of the tank and boring SB-2 was advanced on the east side of the tank.
Each boring was advanced to an approximate depth of 6 feet bgs. The approximate boring locations are indicated
on Figures 2 and 3 in Attachment A.

Soil cuttings from each boring were observed for signs of petroleum impact, such as petroleum odors and/or soil
staining. Petroleum odors were noted in soil cuttings from each boring. Based on site observations, soil from
each boring was field screened with a PID. Field screening results ranged from 91.6 parts per million (ppm) at 3
feet bgs to 375 ppm at 6 feet bgs in boring SB-1. Field screening results ranged from 0.1 ppm at 3 feet bgs to 401
ppm at 6 feet bgs in boring SB-2. After field screening, a soil sample was collected at the termination depth of
each boring (approximately 6 feet bgs) for laboratory analysis. Soil samples SB-1 and SB-2 were collected for
analysis for TPH GRO and TPH DRO by EPA Method 8015. Sample depths and PID readings are presented on
Table 1 in Attachment B.
The soil samples were placed into laboratory supplied containers, and the containers were labeled with sample
identification, analysis, sample date and time. After collection, the samples were placed in a cooler with ice. The
soil samples were delivered by S&ME personnel under chain -of -custody control to Waypoint for analysis.
Once the soil samples were collected, the soil borings were backfilled to the ground surface with soil cuttings
generated during boring installation.
Laboratory Results
Analytical testing of soil samples SB-1 and SB-2 for TPH GRO by EPA Method 8015C indicated TPH GRO
concentrations at 1,030 milligrams per kilogram (mg/kg) in sample SB-1 and 1,610 mg/kg in sample SB-2. The
reported TPH GRO analytical results are above the corresponding North Carolina Department of Environmental
Quality (NCDEQ) TPH GRO reporting level of 50 mg/kg.
Analytical testing of soil samples SB-1 and SB-2 for TPH DRO by EPA Method 8015C indicated TPH DRO
concentrations at 17,800 mg/kg in sample SB-1 and 39,400 mg/kg in sample SB-2. The TPH DRO analytical results
are above the corresponding NCDEQ TPH DRO reporting level of 100 mg/kg.
The analytical results are presented on Figure 2 in Attachment A, and the analytical results are summarized in
Table 1 in Attachment B. The Waypoint laboratory analytical report is included in Attachment C.
Summary, Conclusions, and Recommendations
Summary
The following summarizes the work at the subject property during this project.
The UST soil sampling field activities were conducted on January 11, 2023.
9402 Mallard Creek Road
The potential UST vent pipe was documented to be a grounding rod by the homeowner. The
homeowner informed S&ME that a heating oil UST was historically removed from the east side of the
house in the 1970s.

The location of the former UST could not be assessed due to the construction of a sunroom over the
area.
9602 Mallard Creek Road
The heating oil UST at 9602 Mallard Creek Road was oriented perpendicular to the residential
structure. Based on field measurements, the heating oil tank has an approximate volume of 580
gallons. Approximately 560 gallons of fluid were estimated to be in the tank. The bottom of the tank
was measured to be approximately 59 inches bgs.
Two soil borings (SB-1 and SB-2) were advanced on the east and south side of the heating oil UST.
Each soil boring was advanced to an approximate depth of 6 feet bgs. PID field screening results
ranged from 0.1 ppm to 401 ppm.
Two soil samples (SB-1 and SB-2) were collected at the termination depth of each boring, and the soil
samples were submitted to Waypoint for analysis for TPH GRO and TPH DRO by EPA Method 8015.
Analytical testing indicated the presence of TPH GRO ranging from 1,030 mg/kg to 1,610 mg/kg and
the presence of TPH DRO ranging from 17,800 mg/kg to 39,400 mg/kg. The TPH GRO and TPH DRO
analytical results for both soil samples exceeded the corresponding NCDEQ reporting levels for GRO
and DRO
Conclusions
The following conclusions are based on the field activities and findings of this assessment:
Based on the presence of petroleum odors observed during soil boring activities, and the TPH GRO and
TPH DRO concentrations for soil samples SB-1 and SB-2, it appears that a release has occurred from the
heating oil UST at 9602 Mallard Creek Road.
Recommendations
S&ME provides the following recommendations based on the findings of this assessment:
Due to the analytical results above NCDEQ reporting levels, a copy of this report should be provided to
the NCDEQ as notification that a petroleum UST release has occurred on the property.
Limitations
This report is provided for the use of Delray at Mallard Creek, LLC and the NCDEQ. Use of this report by any other
parties will be at such party's sole risk and S&ME disclaims liability for any such use or reliance by third parties.
Environmental assessments are inherently constrained in the sense that conclusions are developed from
information obtained from limited research and site evaluation. The laboratory analytical results are
representative of conditions that existed on the date these samples were collected. The results presented in this
report are indicative of conditions only during the time of the sampling and of the specific areas referenced.
Conclusions about the site conditions under no circumstances comprise a warranty that conditions in all areas
within the site are of the same quality as those sampled. In addition, contamination may exist in forms not

The above referenced project has been analyzed per your instructions. The analyses were performed in
accordance with the applicable analytical method.
The analytical data has been validated using standard quality control measures performed as required by the
analytical method. Quality Assurance, method validations, instrumentation maintenance and calibration for all
parameters were performed in accordance with guidelines established by the USEPA (including 40 CFR 136
Method Update Rule May 2021) unless otherwise indicated.

Hi Trudy,
Thanks so much for taking my call. As discussed, this morning, S&ME conducted a
Phase II ESA on the property and assessed an unregulated heating oil UST near a former
on -site residence. Following the Phase II ESA, the contractor removed the UST without
notifying S&ME. Therefore, samples were not collected post -removal. S&ME
then mobed to the site, and the contractor excavated soil, dependent on soil screening
and obvious impacts (staining and odor). Due to the excavator limitation, the basin was
excavated to approximately 11 ft bgs and could not be advanced further. Four sidewall
samples and one basin sample were collected. According to the analytical report, the
four sidewall samples did not have detections above method laboratory detection
Limits. However, the basin sample had SVOCs detected
above Soil to Groundwater MSCCs, and aliphatics and aromatics were detected
above Residential MSCCs. Due to the exceedances, S&ME mobed to the site yesterday.
The contractor removed soil from the basin until bedrock was encountered at 14 bgs.
Due to the bedrock encountered, the excavator could not advance further.
Based on our conversation, we discussed two options:
1. Install a temporary monitoring well and attempt to get an NFA without restrictions.
2. Since the source and contaminated soil were removed horizontally and vertically
until bedrock was encountered, a soil use restriction will not be implemented, but
a NORP can be filed with the property deed restricting groundwater use.
I will speak with the client and see how they would like to proceed. We will provide a
report documenting our activities and findings.

At the request of Delray at Mallard Creek, LLC (the current property owner), S&ME is providing this notification of a
heating oil UST release at the property at 9602 Mallard Creek Road in Charlotte, Mecklenburg County, North Carolina.
Analytical testing of two soil samples collected adjacent to a former heating oil UST indicated the presence of DRO and
GRO at concentrations above NCDEQ reporting levels. A copy of S&ME's Limited Soil Sampling Report and a completed
UST-61 Form are attached.
