PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: 1) 15A NCAC 13B .0563 (1)(a) states “The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash.” Resolved 2) 15A NCAC 13B .0563 (3) states “An individual permit is required…for the construction and operation of a Land Clearing and Inert Debris (LCID) landfill when: (a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste management plan as approved by the Division of Solid Waste Management, and (b) The total disposal area is greater than two acres in size.” Unresolved 3) 15A NCAC 13B .0566 (1) states “Operational plans shall be approved and followed as specified for the facility.” Unresolved-corrective measure in progress. 4) 15A NCAC 13B .0566 (2) states “The facility shall only accept those solid wastes which it is permitted to receive.” Resolved FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 67E_INSP_20241106 Page 2 of 4 5) 15A NCAC 13B .0566 (4) states “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Unresolved-corrective measure in progress. 6) 15A NCAC 13B .0566 (5) states “120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. The Division may require further action in order to correct any condition which is or may become injurious to the public health, or a nuisance to the community.” Unresolved-corrective measure in progress. 7) 15A NCAC 13B .0566 (6) states “Adequate erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent excessive on site erosion.” Unresolved 8) 15A NCAC 13B .0566 (7) states “Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development.” Unresolved OBSERVED VIOLATIONS: 1) 15A NCAC 13B .0563 (3) states “An individual permit is required…for the construction and operation of a Land Clearing and Inert Debris (LCID) landfill when: (a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. ADDITIONAL COMMENTS: 1) This facility is a Land Clearing and Inert Debris Landfill. 2) This facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, and inert debris such as unpainted rock, brick, concrete, and concrete block. 3) *This Facility is currently operating with an expired permit. An updated permit renewal request needs to be submitted to the Solid Waste Section for review. Please note that the failure to submit the necessary permit renewal request will result in the closure of this facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as ma be necessar to achieve com liance with the North Carolina Solid Waste Mana ement Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 67E_INSP_20241106 Page 3 of 4 4) The facility access road is of all-weather construction and is currently being maintained in overall good condition. 5) A Caterpillar D6D Crawler Dozer and a John Deere 570B Motor Grader are maintained on site for facility operations and maintenance. 6) The facility is secured by means of a locked gate at the site entrance and has controlled access for safety. The gate was unlocked and open upon my arrival and an attendant was on site during this inspection. 7) The permitted disposal area has not been marked to identify the permitted landfill footprint. * Within 30 days of receipt of this report, please install permanent, highly visible markers accurately delineating the permitted waste disposal boundary and all required buffers. 8) The active working area was in the process of being compacted and covered during this inspection. * Moving forward, please ensure that all waste is covered with one foot of suitable soil monthly, or when the active working area reaches one acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors, or excessive water infiltration. 9) Work is ongoing to compact and cover the eastern end of the landfill. *Please continue working to compact and cover all exposed waste. All newly covered areas should be graded at a slope not greater than 3:1, seeded, and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. Moving forward, please ensure that all waste is covered with one foot of suitable soil monthly, or when the active working area reaches one acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors, or excessive water infiltration. 10) Portions of the outside slopes and the area surrounding the toe of the landfill have recently been mowed. Please continue working to mow/remove all brushy type vegetation and small trees growing on the outside slopes and in the area surrounding the toe of the landfill. *Within thirty days of receipt of this report, please FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 67E_INSP_20241106 Page 4 of 4 complete the removal of all brushy vegetation and trees from the outside slopes and the area surrounding the toe of the landfill. Moving forward, a regular maintenance schedule which includes periodic mowing of all landfill sideslopes and the area around the toe of the entire landfill should be implemented in order to properly maintain and inspect the landfill. 11) Soil has been stockpiled on the top lift of the landfill for use in cover and grading activities. 12) Portions of the outside slopes appear to be graded at a slope greater than 3:1. *Please ensure all outside slopes are graded at a slope not greater than 3:1. 13) The waste type was reviewed. Only landclearing and inert debris were observed disposed on site during this inspection. 14) Scrap concrete and asphalt has been staged on the top lift of the landfill in an area adjacent to the active working face for re-use. Please note that the State rules regarding recovered materials state that for a material to qualify as a recovered material, the majority of the material (75% or more) must be sold, used, or re-used within the calendar year of receipt. 15) No off-site erosion was observed during this inspection. 16) *Continued corrective measures are required as a result of this report.
