Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL CO MMENTS 1. David Powell met with Moore County staff to conduct a comprehensive inspection. Roads were of all-weather construction, and the facility is behind gate/fence beyond entrance. A water truck is available for dust management and is helping. Permit renewal application and corresponding documents should be submitted 180 days prior to the permit expiration date of July 25, 2025, which would be January 26, 2025. In addition, please update
the Operations Plan for the T and P to represent the current operations onsite. Currently the plan states, “The ground material will not be distributed to the public or composted by the County. It will be transported to either a compost facility, a wood waste burner, or used on-site.” The county is currently composting, and some waste goes to public sources after it meets times and temps, which meets rules, the operation plans just needs to reflect these options.
2. Yard waste (YW) material didn’t have any visible unapproved waste during inspection. Good job. The site was neat and orderly. Simmons and Simmons equipment is onsite and being setup to mulch waste onsite. Since last visit, Mr. Brown stated that once windrows were removed from the eastern side, soil was added, and the area was graded further, and site has been greatly improved with its padding of the areas where waste will be windrowed and staged. The area of concern with standing stormwater was on the east side of the T and P area. These improvements will assist with stormwater management and minimize leachate creation and run off. Good job. The Western side
is receiving raw YW currently and is being mulched then windrowed. A roll off on side of the access road for unapproved waste.

On the east side of T and P with a western view. 3. Unclean wood pallets are separated to the side. The signage is still present, and no unapproved waste was visible.
Logs are separated as well for ease of mulching operation. Waste will go to a contractor that will combine with other consistent waste stream boiler fuel. Good job.

4. There is still a good amount of material onsite. All YW is mulched and composted, then sent out to offsite vendors who add it mostly to soil and then sell it as soil amendment. Some mulch is used for ADC at Moore County CDLF, erosion control or to assist with vegetation establishment around facility or closed MSW. Some off-site locations consist of Uhwarrie landfill, Brooks or Walburg Sand. The county was also working with Carolina Tire to use some for-erosion control on side slopes etc. on their landfill.
T and P maps in office. 5. Temperature records were available and reviewed, along with a new map. These records have improved with new aerial maps identifying windrows, etc. Good job. Permit, operations plan, annual reports certifications, vendor contracts, previous inspection reports, waste screenings, daily checklist, and load checks for facilities onsite were also reviewed. Remember compost temperatures must be 131 degrees F for three consecutive days, not average. All waste had met time/temp requirements for the previous year on records reviewed but composting was continued and monitored to create a better product.

6. Area 2 for the T and P storage is located between the access roadway to CDLF and T and P and the Transfer Station and scrap metal. This area is also designated a Temporary Disaster Debris Site, not active. The area has had all waste removed, soil added and been graded. Good job. The site now has some roll-offs stored but they can be quickly removed if storage area is needed.

All operators and managers associated with operations at the T and P should be familiar with 15A NCAC 13B .1400 rules but especially .1406, which is the OPERATIONAL REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES. In addition, 15A NCAC 13B .0300 rules but especially .0302 OPERATIONAL AND CLOSURE REQUIREMENTS.

8. Discussions onsite consisted of the possibility of a new Temporary Disaster Debris Site being designated near the rear of the facility at the barrow site. Mr. Powell later emailed the county staff link to Sections website with available guidance and proper documents to evaluate the site and submit an application if met with prescreening by county. If this site seems to meet rules by county, they can fill out the application, submit a map and necessary documents for review.
