Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS 1. David Powell met with Moore County staff to conduct a comprehensive inspection. Roads were of all-weather construction and the site was fenced and gated. Moore County Landfill entrance. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 2. The facility was visited on the north, west and south sides. Currently the county is slowly filling sunken areas as conditions allow, updating EOW markers and adding EOW markers were needed. Good job, please continue to be proactive and diligent. In addition, some vents were recently added along the access roadway on the north side in response to monitoring results. The site was mowed across the landfill. As EOW is remarked, if there are trees or shrubs inside EOW, please evaluate them in regard to closure plan and approved documents. No trees or shrubs should be growing inside EOW, discuss with Section Permitting a plan for removing and restoring the cap in case of larger than 6-inch diameter trees and shrubs. Some wells were visited around the facilities as well. Wells consisted of GP-20, MW9, MW11SR, 3576, and MW14. Locks and identification tags were in place and the structure looked well maintained. Discussions onsite were that the county wanted to evaluate recycling clean concrete and have it crushed for road building etc. The idea also consisted of storing, staging and crushing the concrete between the access roadway and the EOW at the Closed MSW on the NW corner. Currently the EOW is marked in this area, but upgraded markers have not all been installed yet. Based on what’s visible onsite, and if the EOW markers are accurate, there is a considerable amount of space, in this area, that may be suitable for the concrete staging. Mr. Powell suggested confirming the EOW, consulting the counties engineering firm and Section permitting John Nguyen, (919) 707 – 8183 or john.nguyen@deq.nc.gov, to be sure of any issues with this plan as well as if there need to be any type of permit amendment or plan submitted to DEQ. A map and documentation confirming EOW and an updated facility operation plan would need to be submitted. This operation would need to meet § 130A-309.05 as well. This plan would save space in CDLF and give a resource for the county to have nearby anytime they need crushed concrete. 5. Recommend that the perimeter of the facility outside the EOW be inspected for seeps or releases more than usual. This is a part of the weekly checklist Mr. Lambert created previously. Be sure not to be counterproductive with big equipment with wet soil conditions on top the closed MSW. Do not damage the cap.
