PURPOSE OF SITE VISIT: Comprehensive Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility is a temporary holding site for yard trash, limbs, and brush collected curbside from residents of the Town of Knightdale. 2. 15A NCAC 13B .1406 (6), “A site shall only accept those solid wastes that it is permitted to receive.” At the time of this inspection, plywood, dimensional lumber, and plastic were observed within the limb and brush pile located on the eastern side of the facility. Some windblown municipal solid waste (MSW) and litter were also observed in and around the waste piles. This facility is permitted to receive garden waste, silvicultural waste, and untreated and unpainted wood waste only. Ensure that all unacceptable wastes are removed from incoming loads prior to dumping, and either loaded back onto collection vehicles or placed in containers and promptly removed from the site for proper disposal. 3. At the time of this inspection, the yard trash and the limb/brush piles each had been pushed into the adjacent tree line and had overtaken several trees. Please pull yard waste storage piles back from the tree line and install durable, easily visible markers delineating the limits of the two-acre (or less) notification. Yard waste storage piles should be surrounded by an unused and cleared area of no less than 25 feet to maintain adequate fire breaks and to allow access for fire or emergency response vehicles. 4. The facility is not open to the public and no signs are posted. Mr. Johnson stated that the access road has a metal cable to prevent access, but it is rarely used, and trespassing does occur. A locked gate can be an effective deterrent to unauthorized entry and dumping. It is recommended that the existing cable or a locking gate is utilized to secure the facility when not in use. 5. The current facility operations area appears to be less than two acres in size. The access road to the facility is of all-weather construction and is maintained in fair condition. 6. Mr. Johnson stated that yard waste is hauled offsite to various contractors, including Carolina Tree Debris, periodically throughout the year. Continue to ensure that incoming waste is removed from the site within a calendar year and that the facility stores no more than 6,000 cubic yards of material onsite at any given time as required by Rule .1402 (6)(A). 7. No areas of standing water or erosion were observed during this inspection. 8. Digital photographs were taken during this inspection.
