PURPOSE OF SITE VISIT: Comprehensive Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. The facility accepts land clearing debris and yard waste generated from projects completed by the Lee County NCDOT Highway Maintenance Division and their subcontractors. 2. 15A NCAC 13B .1406 (6), “A site shall only accept those solid wastes that it is permitted to receive.” At the time of this inspection, two large piles of soil and inert debris totaling approximately 20,000 cubic yards of material were stockpiled within the 2-acre Yard Waste Notification (YWN) facility. Scrap tires, plastic, and metal were observed within the westernmost pile. This facility is permitted to receive garden waste, silvicultural waste, and untreated and unpainted wood waste only. Ensure that all inert debris waste is screened from the soil piles over the next 6 months and removed from the site. Any non-conforming waste such as scrap tires, plastic, and metal should be removed immediately and disposed of at a permitted facility. Any soil remaining from the screening process should be moved out of the limits of the YWN. Moving forward, at least seventy-five percent, by weight or volume, of recovered inert debris material temporarily stored on the property outside the limits of the YWN should be removed through sale, use, or reuse within a calendar year in accordance with NCGS, Article 9, Chapter 130A-309.05 (1), (2). 3. Please install durable, easily visible markers delineating the limits of the two-acre (or less) notification and required 50-foot property line buffers. Yard waste storage piles should be surrounded by an unused and cleared area of no less than 25 feet to maintain adequate fire breaks and to allow access for fire or emergency response vehicles. 4. The current facility operations area is approximately two acres in size. The access road to the facility is maintained in fair condition. 5. Mr. Cagle stated that a tub grinder is brought in once per year to grind the accumulated tree debris and brush. The mulch generated from yearly grinding is used on various DOT projects. Continue to ensure that incoming tree and brush is removed from the site within a calendar year and that the facility stores no more than 6,000 cubic yards of material onsite at any given time as required by Rule .1402 (6)(A). 6. The facility is secured by a metal gate. However, the gate did not have a lock, was obstructed by a berm of soil and rock, and appeared to have not been closed in some time. A locked gate can be an effective deterrent to unauthorized dumping. It is recommended that the gate is cleared of obstructions and utilized to secure the facility when not in use. 7. No areas of standing water were observed during this inspection. 8. Corrective measures are necessary as a result of this inspection. 9. Digital photographs were taken during this inspection.
