This document also includes permit application information for Treatment and Processing (T&P) and Composting activities at the Key Landfill facility submitted on behalf of Sandy Cross, Inc. This information has been prepared for submittal to the North Carolina Department of Environmental Quality (NCDEQ) Division of Waste Management (DWM) in accordance with the following Title 15A of the North Carolina Administrative Code (15A NCAC) regulations: LCID Landfills [15A NCAC 13B .0563 through .05671, T&P Facilities [15A NCAC 13B .0301 through .03021, and Solid Waste Composting Facilities [15A NCAC 13B .1401 through .14101. 1.1 References Information used to develop the renewal application for LCID Permit No. 0107-LCID-2014 and new permit applications for T&P and Composting activities include the following: Property Boundary was derived from: NC OneMap Parcels. October 29, 2024 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill Permit Number 0107-LCID-2014 Burlington, NC S&ME Project No. 23580498 1.2 Facility Information s 0 The Key Landfill is located at 2380 Sandy Cross Road in Burlington, North Carolina (Appendix I - Figure 1: Vicinity Map). The facility is an LCID landfill permitted to receive land -clearing waste, yard waste, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. The facility is permitted to receive LCID generated within the following North Carolina counties: Alamance, Caswell, Chatham, Durham, Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake. The facility occupies approximately 47 acres. The total active waste disposal area footprint (LCID North Cell and LCID South Cell) is approximately 11 acres. According to information provided by Key Landfill, LCID Landfill Area #1 (1.97 acres) and LCID Landfill Area #2 (1.99 acres) are closed and are covered with soil. Based on information from the facility's Annual Report for the period July 1, 2023, through June 30, 2024, to the NCDEQ, the facility receives an estimated 1,535 cy of waste in an average week; with approximately 60% being land -clearing waste, yard waste, untreated and unpainted wood, 30% uncontaminated soil, and 10% inert debris, and (used) asphalt. On average, approximately 95% of LCID material received is currently being recycled for resale, with an anticipated 100% being recycled in the future, with no LCID waste being landfilled. In addition, landfilled material in the North Cell is being removed and recycled for resale. As part of the permit application for the T&P and Composting at the facility, concrete crushing and staging operations will be on top of Area #1 (1.97 acres), mulching operations on top of Area #2 (1.99 acres), composting operations and removal of LCID material within the North Cell (4.00 acres), and T&P operations within the South Cell (6.05 acres). A copy of the State of North Carolina Department of the Secretary of State Article of Incorporation is included in Appendix II. The agreement also states that Sandy Cross, Inc. has the authority to pursue permit renewals, operations, and plan approvals for erosion and sediment control plans for the Key Landfill. A copy of the agreement letter is included in Appendix III. 1.4 Property Information According to information obtained from the Alamance County Tax Administration Records Search, the Key Landfill Facility is comprised of two tracks of real property owned by Sandy Cross, Inc. A copy of the North Carolina General Warranty Deed is included in Appendix IV. October 29, 2024 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill Permit Number 0107-LCID-2014 Burlington, NC S&ME Project No. 23580498 Table 1-4 Property Information 1.5 Compliance History Review Appendix V includes the Compliance Review form, which documents the applicant's environmental compliance history in accordance with G.S. 130A-295.3(s). 1.6 Floodplains According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Map Panel Numbers 3710889700K and 3710889600K (effective date 11/17/2017) and GIS Web Services FEMA National Flood Hazard Layer (NFHL) geospatial database, the facility operations will not be located in a floodplain (Figure 4: FEMA National Flood Hazard Layer). 1.7 State Nature and Historic Preservation A State Nature and Historic Preservation review was previously performed for the Facility during the disaster debris application process (DS01-012). Appendix VI includes a copy of the letters from the North Carolina Department of Cultural Resources (NCDCR) State Historic Preservation Office (SHPO) provided to S&ME by the NCDEQ-DWM. The facility operations will not affect any archaeological or historical significance or any component included in the State Nature and Historic Preserve. 1.8 Endangered and Threatened Species A North Carolina Natural Heritage Program (NCNHP) database review was previously performed for the Facility during the disaster debris application process DS01-012. Appendix VI includes a copy of the letter from the North Carolina Department of Environment and Natural Resources —Office of Land and Water Stewardship provided to S&ME by the NCDEQ-DWM. The facility operations will not affect any rare species, important natural heritage areas, or conservation/management areas. 1.9 Clean Water Act A North Carolina Natural Heritage Program (NCNHP) database review was previously performed for the Facility during the disaster debris application process DS01-012. Appendix VI includes a copy of the letter from the North Carolina Department of Environment and Natural Resources —Office of Land and Water Stewardship provided to S&ME by the NCDEQ-DWM. October 29, 2024 4 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill Permit Number 0107-LCID-2014 Burlington, NC S&ME Project No. 23580498 The facility operations will not cause a discharge of pollutants into waters of the United States, including wetlands, that violates any requirements of the Clean Water Act. A copy of the erosion and sedimentation control plan Certificate of Plan Approval (ALAMA-2014-028) is included in Appendix VI. 1.10 Buffer Requirements Figure 6: Buffer Requirements Map shows that the facility operations meet the buffer requirements listed below. Group, P.A., a letter has previously been submitted to the NCDEQ. Alamance County has no zoning but does have a heavy industrial development ordinance (HIDO), which has provided an individual county approved and permitted (No. 2013HID0004) LCID use at the facility. A copy of the Alamance County approval permit fee is included in Appendix Vill. 1.12 Local Fire Protection Authority Appendix IX documents that Haw River Fire Department and Northeastern Fire Department have been notified of the site use. 2.0 LCID Permit Resubmittal Renewal / 5-Year Plan This application for Permit Renewal and 5-Year Plan includes an Operations Plan and Closure Post Closure Care Plan. It also includes the estimated remaining permitted capacity and a projected site life of the existing LCID landfill. A recent survey of the North Cell and South Cell was conducted by FEI (FEI) Civil Engineers and Land Surveyors, and the final grade contours derived from the CAD drawing (Base Map -Key 2-2-2022 Landfill_2015-06- 17.dwg) provided by The L.E.A.D.S. Group, P.A. (LEADS) was used to project the remaining airspace (Figure 7A: Existing Contours (April 2024) & Final Grade Contours). October 29, 2024 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill .i..� Permit Number 0107-LCID-2014 Z Burlington, NC S&ME Project No. 23580498 2.1 Remaining LCID Landfill Capacity On April 16, 2024, FEI personnel surveyed the facility to develop existing topographic data of the active North and South LCID landfill area. Vertical and horizontal ground controls for the project were established in the field by FEI personnel. The topographic data developed by FEI consisted of topographic data throughout the area of interest. April 2024, topographic data generated by FEI was imported into ArcGIS Pro as the lower surface for the evaluation. The final grade data generated by LEADS was imported into ArcGIS Pro as the upper surface elevations. The databases were then imported into Surfer" to perform the volume calculations. The Triangulation with Linear Interpolation method was used to create three-dimensional grids of the topographic data. Volume calculations were then derived from the three-dimensional grids. Three methods were used to determine the available airspace within the permitted fill area of the landfill. These methods included the Trapezoidal Rule, Simpson's Rule, and Simpson's 3/8 Rule. The values computed were used to develop an estimated amount of airspace used between the lower and upper surface elevations. The analysis results indicate that the volumetric difference (airspace usage) between the two contour models was 1,081 cubic yards (cy) for the North Cell and 278,523 cy for the South Cell, totaling 279,604 cy. Approximately 17,789 cy of this quantity will be used for a one -foot -thick final cover across the North and South Cells. This yields about 261,815 cy of airspace remaining available for waste disposal on April 16, 2024. 2.1.1 Site Life Projections The site life projection of this LCID Landfill was estimated based on information supplied by Key Landfill and the facility's Annual Report for the period July 1, 2023, through June 30, 2024, to the NCDEQ. The facility receives an estimated 1,535 cy of waste in an average week. Of this amount, it was conservatively estimated that about "95 percent" would be recycled or removed and sold. This estimate assumes no significant increases or decreases it loads per year. At the current projected disposal rate, the landfill should achieve its maximum capacity within the third quarter of 2084. 2.1.2 Cross Sections The cross sections are shown in Figures 7A and 713. Cross sections A -A' and B-B' are taken along the major axis of the North Cell and C-C' and D-D' are taken along the major axis of the South Celll. The cross -sections show the existing grade and the top of final cover grades. Some areas may require additional site grading before final closure, as depicted in the cross sections. 2.2 Groundwater Separation Based on grading profiles obtained from the NCDEQ Laserfishe digital document management system, we understand that there is a four feet of separation from groundwater levels and the bottom of the waste for the LCID Landfill. The facility will be permitted and operated in accordance with North Carolina Solid Waste Rules 15A NCAC 13B .0301 through .0302. and Solid Waste Composting Facilities [15A NCAC 13B .1401 through .1410]. 3.1 Sitting and Application Requirements - .0301 3.1.1 Floodplain The facility operations will not be located in a floodplain (See Section 1.6). 3.1.2 State Nature and Historic Preservation The facility operations will not affect archaeological or historical significance or any component included in the State Nature and Historic Preserve (See Section 1.7) 3.1.3 Endangered and Threatened Species The facility operations will not affect any rare species, important natural heritage areas, or conservation/management areas (See Section 1.8) 3.1.4 Clean Water Act The facility operations will not cause a discharge of pollutants into waters of the United States, including wetlands, that violates any requirements of the Clean Water Act. October 29, 2024 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill .i..� Permit Number 0107-LCID-2014 Z Burlington, NC S&ME Project No. 23580498 unused and cleared area no less than 25-ft for fire and emergency response. 3.2 Operational and Closure Requirements - .0302 3.2.1 Operation Plan The Operation Plan is included in Appendix X 3.2.2 Closure Plan The Closure Plan is included in Appendix XI 4.0 Type 1 Compost Permit Application The following section is a new permit application submitted on behalf of Sandy Cross, Inc. for Composting and Mulching operations at the Key Landfill (See Section 1 for General Facility Information). 4.1 Requirements for Permit - .1401 The facility will be permitted and operated in accordance with North Carolina Solid Waste Rules 15A NCAC 13B .1401 through .1410. 4.2 General Provisions - .1402 The Key Landfill will receive brush and yard waste generated within the following North Carolina counties: Alamance, Caswell, Chatham, Durham, Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake. This application is for Key Landfill to be permitted as a Large Type 1 Solid Waste Composting Facility with Mulching Operations. The finished products for sale will meet the requirements of .1407. 4.3 Prohibitions - .1403 Hazardous waste or asbestos -containing materials will not be accepted at the facility. Household waste will not be accepted by the facility. If unauthorized material is delivered to the site, the vehicles will be turned away at the gate. If unauthorized waste is seen at the tipping pad, it will be collected by the appropriate personnel and returned to the source/generator for proper disposal off site at a facility authorized by the Department to receive such waste. 4.4 Siting/Design Requirements - .1404 4.4.1 Floodplain The facility operations will not be located in a floodplain (See Section 1.6). October 29, 2024 Permit Applications Key Land Clearing and Inert Debris (LCID) Landfill Permit Number 0107-LCID-2014 Burlington, NC S&ME Project No. 23580498 4.4.2 Buffer Requirements The facility operations meet the buffer requirements listed below (See Section 1.10). 50-ft from compost area to perennial streams and rivers 50-ft from compost area to property lines 200-ft from compost area to residences or dwellings not owned and occupied by the permittee 100-ft from compost area to water wells 4.5 Surface Waters - .1404 (a)(6) The NCDEQ Division of Water Quality (DWQ) online Header ControllerNC Riparian Buffer Areas map indicates that the Key Landfill is located within the Jordan Lake Watershed. The Key Landfill will not affect the public drinking water supply. 4.6 Closed Disposal Area - .1404 (a)(7) The mulching operations will be located over a closed LCID landfill unit. The mulching operations will be over a pad that is adequate to protect the disposal area cap from being disturbed. Runoff will be directed away from the cap and side slopes of the closed unit. 4.7 Fire Equipment Access - .1404 (a)(8) Windrow areas will be spaced at least 25 feet apart and access will be maintained around the windrows allowing adequate distance for fire -fighting equipment to access the area. 4.8 Surface Water Discharge - .1404 (a)(9) The facility will be operated such that stormwater is diverted from operational areas and material stockpiles and that windrows are arranged parallel to site slopes to control stormwater, ponding, and other discharges adequately. Grading will ensure that sheet flow from the permit area is not channelized. 4.9 Ground Water Protection - .1404 (a)(10) The Type 1 classification does not require groundwater monitoring at the Key Landfill. 4.10 Other Design Criteria - .1404 (c) The Key Landfill will have a locked gate at the access road. The surrounding densely wooded areas and fencing will limit access to the remainder of the property. A copy of the erosion and sedimentation control plan Certificate of Plan Approval (ALAMA-2014-028) is included in Appendix Vill. Compost piles will not be turned on high wind days, and the facility will have access to water to spray down the operations area if dust becomes a nuisance. Odor is not a common concern for this type of operation. However, lime can be mixed into the windrows if odor becomes an issue. 4.11 Operational and Closure Requirements - .0302 The Operation Plan is included in Appendix X. 5.0 Temporary Disaster Debris Site, DS01-012 The Key Landfill will incorporate storm debris as part of normal daily activities. The facility presently operates under Permit No. 0107-LCID-2014. The current facility occupies approximately 47 acres. 1.2 Purpose The purpose of the Operations Plan is to provide written, detailed instructions for construction and daily operations of this landfill. It also presents the fill progression of the facility in a clear and comprehensive manner with respect to its site life. This plan will be kept at or near the facility and will be accessible to landfill operators. Fencing and natural terrain prevent unauthorized access to the site for the entire perimeter except through the entrance gate. An operator is on duty while the site is open to assure compliance with operational requirements and prevent the acceptance of unauthorized waste. The entrance road is paved. Crushed stone is placed on the surface of the access road to the operating face of the landfill. 3.0 Type, Source & Quantity of Solid Waste Received In accordance with the regulations, the Operations Plan for the landfill contains a description of the landfill's solid waste receiving process. This includes permitted waste stream, source, inert debris accepted, control and measurement of incoming waste. 3.1 Permitted Waste Types Accepted This LCID landfill may accept those solid waste (inert debris) that it is permitted to receive. Unauthorized use and access to the landfill is prohibited. The following LCID waste is approved for land disposal in accordance with the current permit. It shall not be placed as beneficial fill as defined in Rule .0562 within the site buffer areas or elsewhere on the property unless stated in the site permit. October 29, 2024 4 Operations Plan — Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting Burlington, NC S&ME Project No. 23580498 3.3 Source The facility is permitted to receive LCID generated within the following North Carolina counties: Alamance, Caswell, Chatham, Durham, Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake. 3.4 Control of Incoming Waste Upon entering the facility, haulers are stopped at the office/gatehouse, and each load is ticketed. A landfill employee will inspect the load and direct the haulers to the designated areas for recycling, landfilling, stockpiling, or processing. If unauthorized material is delivered to the site, the vehicles will be turned away at the gate. 3.5 Measurement of Incoming Waste This landfill records all trucks delivering LCID entering the landfill. The entry system shall record the type of waste received and the type/capacity of the truck transporting the waste material. This facility is exempt from the requirement to have an on -site scale. The quantity of waste received may also be estimated from the change in survey data for the landfill site over a period. 4.0 Placement Operations Access to the facility's active areas will be limited to protect neighboring areas that have received cover and vegetation to avoid damage from heavy equipment and vehicles. 4.1 LCID Waste Disposal Waste haulers and equipment operators will be directed to controlled entrance points that lead to the active LCID units. Once at the active face of the disposal area, the operator directs traffic to the proper location to deposit waste material. 4.1.1 Method and Sequence of Filling Waste Permitted waste disposal areas will be filled in such a manner as to achieve the final grades. Appropriate surface water and erosion controls will be constructed in areas that receive final cover. 4.1.2 Waste Material Compaction Waste material will be compacted and sloped as necessary to obtain a neat and safe working area and to conform with the final grades. The frequency of waste material compaction and grading will be dependent on the quantity and physical characteristics of the material received but will occur at a minimum of once each day that waste is received. 4.1.3 Daily Construction of LCID Units Waste material will be generally placed in the landfill in horizontal lifts. The material will be placed, then spread in layers, and compacted using bulldozers or other suitable equipment. Slopes shall not exceed a ratio of three horizontal to one vertical (3H:1V) at any time. The compacted waste material will be graded to a temporary slope and temporary working face slopes no greater than 3H:1 V. Lift depth will vary depending on specific operations, daily volume of material, width of working face, and good safety practices. Access roads in the landfill will have slopes of no more than 10 percent to allow ready vehicular access to the working face, even during inclement weather conditions. The working face of the waste disposal area will be maintained to limit the exposed area. The width of the working face will be controlled to maintain a neat and orderly disposal area and kept only wide enough to accommodate vehicles discharging material. 4.1.4 Elevation Control of LCID Units Grade stakes may be set as needed for the landfill operator and prior to placement of the final waste layers to assist the operator in placing the waste. This will ensure that the disposal capacity of the landfill is fully utilized. Grade stakes will also help to eliminate or reduce the need to move waste or add fill soil to achieve final subgrade elevations. The contractor will fill pockets or depressions in the final surface layer of waste with finer waste or interim cover soil to provide a uniformly graded surface for placement of the final cover. 4.1.5 Periodic Soil Cover of LCID Units Soil cover material is applied to the LCID waste daily, primarily for fire prevention, but also for daily and intermediate cover. In accordance with the current permit, the solid waste is covered with one (1) foot of suitable soil cover at least once per month or when the active area reaches one acre in size, whichever occurs first. It is covered more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors, or excessive water infiltration. This cover soil shall meet the "unrestricted use standards for soils" as defined in GS 130A-310.65. Areas that will not have additional waste placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one (1) foot of soil cover, sloped to direct flow of surface water from the landfill, and stabilized with a vegetative ground cover or other stabilizing material. October 29, 2024 Operations Plan — Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting Burlington, NC S&ME Project No. 23580498 4.2 Recyclable Materials Material hauled into the facility that appears suitable for use as recyclable material will be directed by the operator to offload at the appropriate location within the facility, given the material type. Inert construction debris will be piled and ground or crushed for processing and stockpiled or transported for reuse/resale. Wood, land clearing waste, and yard waste will be sorted for composting, mulching, or stockpiling. Uncontaminated soil, gravel, or rock will be sorted for stockpiling. 4.3 Compost Materials Open -windrows will be constructed within the designated windrow areas. The windrows will be constructed using layered feedstocks as materials are available and periodically aerated with specialized windrow turning equipment. The height and width of the windrows will be determined by the mechanical design of the machinery used for the turning process. The stabilizing of the compost product is achieved through a process that allows for the gradual reduction of microbial activity in the presence of moisture and aeration. A process duration of at least four to six months is typical for composting and curing. Windrow temperatures will be recorded at multiple locations within the compost pile during the active composting phase. Temperatures will be taken daily until the piles reach and maintain a temperature of 131OF or higher for at least three consecutive days. 4.4 Equipment The required operation equipment to be used at this Landfill is suitable for excavation, hauling, placement and compaction of waste materials. Equipment is sized appropriately to maintain site daily operations of waste placement and compaction and ancillary functions as required. Vehicles and equipment used by employees at the landfill are equipped with safety devices as required by law. Landfill equipment will have fire extinguishers on board as needed. Communication equipment available to landfill personnel consists of cellular phones and/or radios for communication between personnel operating company vehicles and equipment. Routine maintenance and cleaning will be performed as necessary to keep the equipment in good operating order. In the event of primary equipment failure, backup equipment will be obtained as necessary. If additional equipment is needed, it is available by local rental. 4.5 Provisions for Closure When the final design grades for the landfill are reached, the landfill will be closed. Key Landfill maintains the personnel and equipment necessary for final closure of the LCID Landfill. A separate Closure/Post-Closure Care Plan has been prepared for the facility under a separate cover. Final Closure and Post Closure Care will be completed in accordance with this approved Plan. 4.6 Surface Water and Leachate/Contact Water Surface water runoff or management system for the site consists of collecting runoff by directing the flow to the sediment basin, prior to discharge. Surface water will be diverted away from the working face and shall not be allowed to impound over the waste. Within the active portion of the landfill, all working areas will be maintained and graded to allow stormwater to be diverted around the active face of the landfill toward a peripheral collection channel. Leachate or contact water will be contained and managed on -site. Solid waste will not be disposed of in water. 5.0 Environmental Management The following addresses environmental management requirements for successful operation of this LCID landfill. 5.1 Erosion and Sediment Control Earth -disturbing activities will be conducted in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq., and rules promulgated under 15A NCAC 04. from leaving the site. Erosion control measures, structures, or devices shall be utilized to avoid on -site erosion and prevent silt from leaving the site. Dust control measures will be implemented when necessary. Facility construction, operations or practices shall not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. Any modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The permittee must notify the Section of any sedimentation and erosion control plan modifications. The sediment control and stormwater conveyance features will be inspected regularly for sediment build-up or erosion damage. They will be cleaned out when sediments fill the lower half of each structure and maintained in accordance with regulatory requirements. Construction of side slopes will be limited to 3H:1 V or flatter. Temporary or permanent vegetation or other stabilizing material will be established on closed or interim closed areas as required. Final Cover will be inspected regularly for erosion damage and promptly repaired in accordance with the post closure care plan for this facility. 5.2 Dust Control Dust originating from the access/haul road to the landfill will be controlled by enforcement of speed limits and periodic watering, as necessary. Dust is also controlled in landfilling areas by establishing vegetative cover on final cover slopes and on areas which will not be active for extended periods of time. As an alternative to vegetative cover, woodchips may be used for dust control. Petroleum products will not be used for dust control. 5.3 Litter Control Due to the nature of the permitted waste material for disposal and recycling, control of blowing litter will not be an issue. However, compost turning and mulching will not occur on high -wind days. 5.4 Odor Control Due to the nature of the permitted waste material for disposal and recycling, odor is not expected to be of concern. However, if odor becomes a noticeable issue with composting, lime will be applied and mixed into the windrows. 5.5 Vector Control Due to the nature of the waste disposed and recycling operations, vector control is not expected to be of concern. Positive drainage will be maintained to inhibit ponding and eliminate breeding places for rodents, flies, etc. The landfilled waste is not expected to provide food for rodents or flies. For composting activities, landfill staff will be knowledgeable about the "aerobic" and "anaerobic" characteristics of windrow composting. In addition, windrows will be aerated periodically. 5.6 Noise Control Operating activities will be limited to daylight working hours only. A minimum 100-foot buffer is also maintained between the property line and limits of waste around the entire site; therefore, noise generation is not expected to be a problem. 5.7 Groundwater Quality Control The bottom elevation of the waste shall be no less than four feet above the seasonal high groundwater table as defined in Rule .0532 of this Section. 6.0 Emergency Contingency Plan The purpose of the "Contingency Plan" is to provide the site with a guidance tool in the event of fire, explosion, or other event that would threaten human health and safety of the environment and equipment failure. The material contained in this plan will allow key personnel to respond quickly to contingencies during the construction and/or operation of this landfill in an organized, planned, and coordinated course of action. It is important to note that, even with careful planning, there is always the necessity to improvise and remain flexible. However, general planning and resource identification offer immediate direction. 6.1 Inclement/Wet Weather Operations During periods of inclement weather, the operator shall determine the facility's ability to handle and intake waste material. The operator will determine the suitability of the on -site haul roads, determine alternate disposal routes, or stop operations. The facility will stop all operations during adverse weather conditions. Repairs to erosion ruts and maintenance of access roads and stormwater management features will be performed as needed. Waste materials will not be deposited in standing water. 6.2 Unauthorized Waste Management If unauthorized material is delivered to the site, the vehicles will be turned away at the gate. If unauthorized waste is seen at the tipping pad, it will be collected by the appropriate personnel and returned to the source/generator for proper disposal off site at a facility authorized by the Department to receive such waste. 6.3 Fires Protection and Control The chance of fire occurring at a properly run LCID landfill is limited. Fire protection procedures may include maintaining large equipment and soil stockpiles in the vicinity of the working face. Soil is mixed with LCID waste on a daily basis to avoid fires. No open burning of land clearing, or inert debris solid waste is permitted at this facility. If a fire is detected, the hot spots are excavated, and additional soil is applied to smother the fire and deplete the burnable source material. The application of soil will be used to contain, control from spreading, or extinguish fires by cut off the flow of oxygen into the burning area. The facility must maintain a supply of cover material adequate to cover the working face in case of an emergency or fire, at all times. The local fire department will be contacted to assist site personnel and equipment. Appropriate fire extinguishers will always be carried on the equipment and can be used to control any small equipment fire that may occur. If a fire occurs, the permittee will provide oral notification to the Department within 24 hours of the occurrence, followed by a written report of the details of the fire within 15 days of the occurrence. The report will include the date, time, and cause of the fire; the location(s) on the premises; type of waste that caught fire; the dimensions and volume of material involved; actions taken by the owner/operator; a description of emergency response activities with results; and a description of mitigation measures implemented to reduce or eliminate conditions leading to the fire. This report will be dated and include the name and title of the person submitting this information. Depending on the severity or nature of the fire, additional information may also be required by the Department. It shall not exceed the LEL for the gases at the property boundary. Due to the inert nature of the waste material and recyclable material at the landfill, explosive landfill gas is not anticipated. 7.0 Operation Record and Record Keeping Operation records required by the permit are maintained by the permittee at the company office located at: Key Landfill 2380 Sandy Cross Rd. an updated version of the Closure and Post Closure Care Plan for the Key Land Clearing and Inert Debris (LCID) Landfill owned and operated by Sany Cross, Inc. The LCID landfill is located at 2380 Sandy Cross Road, Burlington, North Carolina in Alamance County. 1.1 Purpose The purpose of this Closure and Post Closure Care Plan is to describe the steps, design concepts, and rationale to close the existing LCID Landfill (Permit Number 0107-LCID-2014). General procedures for inspection, maintenance, and monitoring during the post closure care period are also described in the Plan. This Plan has been prepared in accordance with the requirements of the North Carolina Administrative Code (NCAC) 15A NCAC 13B Rule .0565 and Rule .0567. The facility is permitted to receive LCID generated within the following North Carolina counties: Alamance, Caswell, Chatham, Durham, Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake. Access to the site is via a gate off Sandy Cross Road. The facility occupies approximately 47 acres. The total active waste disposal area footprint (LCID North Cell and LCID South Cell) is approximately 11 acres. According to October 29, 2024 4 Closure/Post Closure Care Plan for Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting .� Burlington, NC S&ME Project No. 218983 I I information provided by Key Landfill, LCID Landfill Area #1 (1.97 acres) and LCID Landfill Area #2 (1.99 acres) are closed and are covered with soil. 1.4 Expected Year of Closure The expected year of closure for this landfill is 2084. However, if the disposal rate increases, final closure could occur sooner. 2.0 Closure Plan The purpose of this Closure Plan is to describe the steps necessary to close this LCID landfill at any point during its intended operating life in accordance with current NCDEQ regulations. These procedures apply to the final closure of a section during operations or the entire landfill at final closure. The purpose of final closure implementation is to prevent exposure of waste and preclude post closure release of pollutants to the environment. 2.1 Temporary Erosion and Sediment Control Prior to the start of final cover construction, temporary perimeter erosion control features (i.e., silt fencing, compost filter sock, silt fence outlets, etc.) will be installed, as needed. Silt fence or compost filter sock could be used as temporary erosion and sediment control, down slope of the disturbed area of the landfill. Silt fence will not be installed across streams or ditches where flows are concentrated. Outlets for silt fence or compost filter socks may be utilized to reduce the potential concentration of flow along the measures. Additional sediment control measures such as stormwater diversions or a skimmer/sedimentation basin may be used if necessary. During final cover construction activities, the temporary erosion control features will be inspected every seven (7) calendar days and after storm events that produces one inch or more of precipitation within 24 hours, until adequate vegetative cover is achieved. Inspections will be documented in a logbook. Temporary erosion control features will be repaired or replaced if any such features have been damaged from runoff, or if there is excessive sediment buildup behind the silt fence that would impede the performance of the feature. When the inspection results show that a repair is required, a repair or replacement shall occur within seven (7) days of such a notice. The temporary erosion and sedimentation control measures will be maintained until the permanent vegetative cover is established. 2.2 Final Grading The final surface of the landfill shall be graded in accordance with the final cover design grades to promote positive drainage, prevent ponding and minimize erosion of the cover soil. Final grading will be conducted after the landfill phase has reached its final approved elevations or landfilling has ceased to occur in the phase. The exterior side slopes of this landfill will be graded to not be any steeper than 3HAV to comply with the permit and facilitate maintenance. The top slope will not be any flatter than five percent to enable positive drainage to prevent water from ponding on top of the landfill final cover, due to settlement within the waste. October 29, 2024 Closure/Post Closure Care Plan for Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting �r Burlington, NC S&ME Project No. 218983 2.3 Surface Water Management The surface water management system for final closure of this landfill will be developed prior to final closure of the site and will be based on the actual site grades at the time of closure. 2.4 Periodic and Final Cover Description Once an area of the landfill area has reached its capacity or final design grades, it should be progressively closed by constructing a final cover in phases. 2.4.1 Periodic Cover In accordance with the current facility Operating Permit, the solid waste shall be covered with at least one foot of soil at least once per month or when the active area reaches one acre in size, whichever occurs first or more often when necessary. This periodic cover is intended to prevent the site from becoming a nuisance and to mitigate conditions associated with fire, windblown material, vector, or excessive water infiltration. Periodic cover soils shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. Any alternate periodic cover shall be approved by the NCDEQ. 2.4.2 Final Soil Cover The final cover system or cap for the landfill is designed to minimize infiltration and erosion caused by wind and water. The current regulations for this LCID landfill require the final cover to consist of no less than one (1) foot thick layer of earth cover (soil). In ditches or swales with depths greater than 6 inches and width less than three (3) feet located on the landfill, at least two (2) feet of soil is required between the bottom elevation of the ditch or swale and the waste mass. This final cover shall be clean, natural soil, free from deleterious material. Soil used for final cover (cap) system construction will consist of a 12-inch-thick soil layer that typically classifies as CL, SC, SM. ML, MH, or CH according to the Unified Soil Classification System. 2.4.3 Vegetative Cover According to the regulation, this final cover soil will be stabilized with vegetative ground cover or other stabilizing material. Vegetation with native grasses to prevent erosion of the final cover, promote evapotranspiration, and minimize infiltration is proposed for this landfill. Upon completion of the final cover layer, the surface of the final cover layer will be scarified, fertilized, seeded, and mulched in accordance with the NCDOT Standard Seeding Specifications (Last Revised April 2019) and Erosion and Sediment Control Planning and Design Manual, Section 6.11 (Last Revised May 2013). This vegetative ground cover sufficient to control erosion shall be established within 30 working days upon completion of any phase of the LCID landfill development or as addressed in the Approved Sediment and Erosion Control Permit. 2.5 Notice of Intent to Close Landfill The Owner will notify NCDEQ of their intent to close this facility no less than 90 days prior to the expected closure of the site. A copy of this notice of intent to close will be placed in the facility operating record. October 29, 2024 Closure/Post Closure Care Plan for Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting �r Burlington, NC S&ME Project No. 218983 2.6 Closure Schedule In accordance with requirements under 15A NCAC 13B .0567 (b)(1), the Owner/Operator will begin final cover construction within 30 days of receipt of the final load of waste. Thirty days after receipt of final load of waste will mark the initiation of closure activities. Closure activities will be completed within 120 days after completion of final disposal operations. 2.7 Final Cover Thickness Verification Final Cover thickness verification for this landfill will be documented via a survey conducted by a North Carolina Registered Professional Surveyor. An initial survey will be conducted of the subbase elevations prior to final cover placement. Then a second survey of the final cover surface will be obtained, prior to application of vegetation cover. These surveys will be compared to confirm the in -place final cover thickness is no less than 12-inches and that it is sloped to direct flow of surface water from the landfill in accordance with 15A NCAC 13B .0567 (b)(1)(A). 2.8 Closure Certification Within 30 days of completion of closure of this landfill site, a North Carolina Licensed Professional Engineer must certify that the final cover has been installed in accordance with Rule 15A NCAC 13B .0567(b)(3). Any deviations from this Closure Plan shall be identified to the Division and include an explanation with the Certification. This Certification will be submitted to the Division verifying that closure has been completed in accordance with Rule 15A NCAC 13B .0567(b) and the Facility's permit. Upon receipt of this Closure Certification, NCDEQ may schedule an inspection of the facility prior to issuing final closure approval. A copy of this Closure Certification will be placed within the Facility Records. When the site has been closed in accordance with this rule and the permit is terminated, any future solid was management at the site shall require a new permit. 2.9 Recording/Notice of Deed to the Property Within 30 days of the NCDEQ's issuance of final closure approval, the Owner shall record with the appropriate Register of Deeds a notation in the record of property ownership, or some other instrument normally examined during title search, indicating that the land or portion thereof was used as a land clearing and inert debris landfill. 3.0 Post Closure Care Plan Upon issuance of NCDEQ final closure approval, the permit for this facility shall be modified to incorporate post closure care activities. The Owner will conduct post -closure care following closure of landfill. The objective of these post closure activities is to maintain the integrity and effectiveness of any final cover to ensure that the landfill continues to effectively contain waste materials and is protective of human health and the environment. The Post Closure Care Plan describes the activities involved in providing care for the facility during the post - closure care period. All inspections, maintenance activities, and monitoring activities with results will be conducted throughout the post closure care period and documented according to set procedures laid down in this plan. October 29, 2024 Closure/Post Closure Care Plan for Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting �r Burlington, NC S&ME Project No. 218983 3.1 Inspection, Monitoring, Maintenance and Repair Procedures The site will be inspected and monitored regularly to identify any adverse conditions that might lead to release of material from the landfill that may be harmful to human health or the environment. Routine maintenance and repairs shall be performed to the final cover and surface water management system, as needed, to correct the effects of settlement, subsidence, erosion, or other events or prevent run-on and run-off from eroding or otherwise damaging the final cover. This section addresses the requirements regarding inspection, monitoring, maintenance, and repair of the site. 3.1.1 Visual Inspection & Documentation During the post closure care period, the landfill will be visually inspected semi-annually to identify defects that may compromise the integrity of the final cover system. These inspections will include a walk of the entire site to look for evidence of settlement/subsidence; slope instability; animal burrows; exposed waste; erosion of final surface cover; ponding of water on the final cover of landfill; and any seepage from the side slopes. The final cover system will also be inspected for the presence of undesirable vegetation such as trees and large shrubs. The access roads and site security features will also be inspected. Repairs due to a deficiency or any other maintenance required will be documented and performed on an as needed basis as described herein. 3.1.2 Final Cover System Monitoring Maintenance and Contingency Plan for Repairs The final cover surface will be inspected for stressed vegetation, desiccation, erosion, subsidence, animal burrows, slope instability, and inadequate vegetative cover. To help identify potential areas of erosion and stressed vegetation, one inspection will be conducted when the vegetative growth is minimal, and a second inspection will be conducted during the period when the vegetation is well established. If a defect in the final cover system is identified during an inspection, repairs will be initiated as soon as possible, within seven (7) days of detection, to minimize further erosion. If a defect is severe and repairs cannot be implemented in a reasonable time period, interim measures will be taken to prevent the defect from getting worse. Mowing operations will be appropriately scheduled during the growing season. Other vegetative management operations include fertilizing the vegetative cap which will be performed on an annual basis, or as needed. A 75 percent or greater vegetative ground cover with no substantial bare spots shall be established and maintained throughout the post -closure period. Vehicular traffic across the vegetated areas of the landfill will be restricted to avoid potential damage to the capping system. Maintenance equipment including lawn mowing equipment will be allowed to operate on the vegetated areas only when necessary. 3.1.3 Surface Water Management System The surface water management system (i.e., the channels, ditches, culverts, etc.) will be inspected semi-annually during the post -closure care period. It will be inspected to see that it is free from sediment, debris or excess vegetation that might keep the system from operating properly. Any blockage will be removed at the earliest opportunity so that the system will operate properly to prevent damage. Surface water management maintenance includes vegetation management and sediment removal from storm water management features. October 29, 2024 Closure/Post Closure Care Plan for Key Landfill (Permit No. 0107-LCID-2014) Land Clearing and Inert Debris (LCID), Treatment & Processing (T&P), Composting �r Burlington, NC S&ME Project No. 218983 3.1.4 Environmental Monitoring The current permit does not require environmental monitoring for groundwater, surface water, or landfill gas at this site. Due to the nature of the waste, the potential for landfill gas generation during the post closure care period is anticipated to be minimal and is not expected to adversely impact the final cover system. 3.1.5 Site Roads The condition of the site access roads will be evaluated during the inspection. On -site access roads will be maintained in a passable condition for fire -fighting vehicles to allow access to the entire waste boundary of the site. This inspection will include observing it for ruts, positive drainage, and adequate aggregate coverage. Road maintenance will be performed as necessary. 3.1.6 Post Closure Inspection Schedule The post closure care period for the LCID landfill is ten (10) years from the date of final closure unless a variance is applied for and obtained. This period may be decreased if the Owner can provide technical rationale that the decreased post -closure period is sufficient to protect human health and the environment. However, NCDEQ has the authority to increase the post closure period if they determine the lengthened period is necessary to protect health and the environment. The initial inspection activity schedule is presented in Table 3-1 for this LCID landfill. Post Closure inspections and maintenance activities conducted will be documented and maintained as described in Section 3.5. NCDEQ may also identify additional actions necessary in writing that they determine are necessary to correct any condition that may be injurious to the public health or a nuisance. 3.2.1 Security Control Device Repair All security control devices will be inspected and maintained as necessary to ensure access to the site is controlled. Locks, vehicular gates, and fencing will be replaced if functioning improperly. Warning signs will be kept legible at all times and will be replaced if damaged by inclement weather or vandalism. 3.2.2 Slope Stability Repairs Signs of surface sloughing, bulging at the toe, tension cracks at the top of the slope, or seepage from the side slopes are usually an indication of potential slope instability. Appropriate corrective actions will be taken to repair any damage as soon as possible. Immediate temporary stabilization measures may include placing a buttress (e.g., large mound of soil or rock) at the toe of the slope to prevent further movement and covering the exposed waste. To restrict further propagation of the slope instability (i.e., additional sloughing or cracking), temporary slope stabilization shall take place as soon as physically possible after detecting. 3.2.3 Subsidence, Holes, Erosion, and Undesirable or Inadequate Vegetation Repair When subsidence, erosion, or animal burrow holes are detected in the landfill final cover surface, the final cover permitted design grades will be restored by backfilling and grading settled or low areas with soil. Undesirable vegetation such as trees and large shrubs will be removed and damage to the final cover surface will be repaired by backfilling and grading. The final contours of the cover will be maintained to provide positive drainage and prevent erosion of the final cover due to surface water runoff. The disturbed areas and areas with inadequate vegetative cover will be re -seeded to restore vegetation for erosion control. 3.3 Post Closure Care Completion Certification Consistent with regulatory requirements, the end of the closure/post-closure care period must be certified by a professional engineer registered in the state of North Carolina. To accomplish certification over the required ten- year duration, a registered professional engineer will prepare closure certifications every five years. The quinquennial certifications will document that the cover system has been monitored and maintained in accordance with the Post -Closure Care Plan. The certifications shall be based on observations and results documented on regular post -closure monitoring reports, maintenance records, and any required environmental monitoring reports maintained in the landfill Operating Record. 3.4 Facility End Use No end use is planned for the closed landfill area at this time. If a proposed post -closure use is identified, approval will be obtained from the NCDEQ. Any post closure use of the closed site shall not disturb the integrity of the final cover or containment system. Post closure use will not interfere with inspection, maintenance, and monitoring activities or undermine the integrity of the final cover system. Property lines shall not be altered to result in the reduction of the buffer areas set or in the Rule or in the facility permit. 3.5 Records Management The Owner will maintain records of routine scheduled inspections and site monitoring activities in the facility operating records. The records will indicate the date and time of the inspection, the name of the inspector, the nature of the inspection or maintenance activity, notation of observations made, and the nature of repairs needed. The inspector will assess the condition and need for repair of the final cover system, surface water control features, and site access roads. Documentation of maintenance performed, and repairs made shall also be maintained. Records shall be made available to NCDEQ for inspection/review upon request during the post closure area period. All records shall be retained during the post closure period as required by the NCDEQ, no less than five (5) years. October 29, 2024 11
