Talked to and emailed Emily on 12/30/2022 about the expired permit. Application for permit renewal received by email on 01/04/2023. The paper application was received by mail on 01/09/2023. Failure to submit the application for permit renewal prior to the expiration date is a violation of Rule .0837(m) that states "Applications for renewal permits shall be submitted to the Division at least 90 days prior to the expiration of the permit. The Division shall notify permit holders of facility permit expiration dates 120 days prior to permit expiration." The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 2 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section ADDITIONAL COMMENTS 1) This facility consists of one above metal tank with a capacity of 3,000 gallons for the storage of domestic and grease septage. 2) "No Trespassing" sign present at tank. 3) Access road to tank in good shape. 4) Tank accessible for inspection. There was an area of at least 5 ft around the tank to allow for inspection. 5) No holes or cracks observed which may allow the escape of septage out of the tank. No leaks noticed. 6) No issues noticed with transfers to and from the tank. Tank does not appear to be in use currently. 7) No vector or odor issues noticed. 8) No setback issues noticed. 9) Permit had expired on 07/07/2022. Talked to and emailed Emily on 12/30/2022 about the expired permit. Application for permit renewal received by email on 01/04/2023. The paper application was received by mail on 01/09/2023.
