Recorded in Vance County Register of Deeds: Book 1323 — Page 483. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The access road was identified around the entire facility, is of all-weather construction, and appears to be properly maintained. 2. The site has adequate signage posted adjacent to the gate and visible from the road. 3. Permanent edge of waste markers were observed during this inspection. 4. The waste stream observed appeared to be clean. No unacceptable wastes were observed within the waste stream. Any identified unacceptable wastes are removed for proper disposal. 5. Mr. Davis was in the process of compacting, covering, and sloping the side slopes. Continue to ensure that the waste is compacted and sloped to meet the three horizontal to one vertical ratio. The waste must be covered with six inches of soil monthly or when the working face reaches one acre in size. 6. Grasses were beginning to grow along the side slopes. 7. No areas of standing water were observed during this inspection. 8. Mr. Faulkner stated that he had a meeting with Vance County Planning and Zoning to discuss whether additional zoning was required for the Tungsten Mine facility. Mr. Faulkner is also in the process of obtaining an LCID permit for another parcel. Ms. Thompson reminded Mr. Faulkner that the Section would need to conduct a pre - operation inspection prior to the acceptance of waste at the new facility. 9. Mr. Keith Snavely, with the Inactive Hazardous Sites Branch, was on -site with an environmental consultant to investigate possible impacts associated with the historical use of the area as a tungsten mine. The investigation is expected to take place near the southern portion of the access roadway. 10. Digital pictures were taken during the inspection.
