STATUS OF PAST NOTED VIOLATIONS:
No violation noted on the previous inspection.
OBSERVED VIOLATIONS:
1) Grease septage overflowed the second tank and flowed onto the ground. The overflow of septage
from the second tank onto the ground is a violation of Rule 15A NCAC 13B .0838(e)(1) that states
"Each detention and treatment facility shall be designed, constructed, and maintained to: (1)
prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the
ground surface, or into any surface waters." Septage needs to be cleaned up off the tank and
ground.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) This facility consists of two 10,000-gallon steel tanks for the storage of domestic and grease septage.
2) The "No Trespassing" sign was posted before you get to the tanks.
3) Access road to the facility is in good shape.
4) Tanks accessible for inspection. An area around the tank greater than 5 feet was clear of any debris or
vegetation hiding the walls of the tank.
5) Grease septage overflowed the second tank and flowed onto the ground. The overflow of septage from
the second tank onto the ground is a violation of Rule 15A NCAC 13B .0838(e)(1). See picture below.
Septage needs to be cleaned up off the tank and ground. Outside of the overflow of septage onto the
ground, no leaks noticed.
6) No objectionable odors or vector issues noticed today.
7) No changes noticed that would impact setback distances.
8) No application for permit renewal has been received. Talked to Maurice in Decemberabout needing the
application.
