STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (4) – UNRESOLVED
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.

During the inspection, attempts were made by Section staff to drive the perimeter access road around the LCID on the eastern side. Although the vehicle would fit, the road was not all-weather construction and could not pass. The road has eroded so access does not connect around the perimeter. Fire fighting vehicles would not be passable in current construction or size. Please improve the road and use all-weather construction. It should be noted that during the onsite discussion with County staff, it was mentioned that the construction bid was given to a company called BMCO and a pre-construction meeting is imminent within the next 20 days.
This company will then have a “start day” of construction on the 4-acre expansion to the existing 3-acre LCID, totaling 7-acres once complete. In addition, BMCO is scheduled to bring additional staff for operating heavy equipment to the landfill to maintain daily operation but also work on previously identified corrective actions.
ADDITIONAL COMMENTS
1. The purpose of this visit was to do a comprehensive inspection and follow-up of the Robeson County Landfills and corrective actions previously identified. Also, this visit was to introduce new Eastern District Supervisor Wes Hare, with the Section, to the staff of the Robeson County Landfill. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. Mr. Walters explained the process of beginning construction is moving forward with LCID with a company called BMCO very soon. Mr. Gene and Ms. Kristina explained they have recently lost three staff and are attempting to hire new staff and get contractors to assist. BMCO is going to assist with additional operators. 2. The site has other permitted facilities onsite nearby such as an active MSWLF and CDLF, which has a closed MSW under the CDLF. All the facilities are behind a fence, lockable gate and have proper signage.

Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further

3. The LCID working face was large but at or under one acre, with much waste to waiting compact and cover. Unapproved waste such as bagged trash, a large couch, and large plastic pieces were observed comingled in the waste. There are many operators onsite across the landfill when the facility is open, however, there isn’t always an operator or attendant stationed at the LCID working face. This still allows for unapproved waste to be dumped and not be caught. Please remove all unapproved waste from the appropriate disposal site and adjust onsite operations to minimize these wastes.

4. EOW markers were added as previously requested. Good job. Cover needs to be increased across the LCID with older areas as well as current working face. Too much waste is being staged before cover is applied. Smaller working faces would be easier to manage. Cover is to be applied with at least 6 inches of soil, once waste reaches one acre in size or monthly, whichever is first, per 15A NCAC 13B .0566. Older areas, such as the north half of LCID, still have exposed waste. Part of this is due to improper cover overtime and some due to erosion and no repairing. Please address accordingly. Mowing is needed in some areas. A
perimeter road was added; however, it is not of all-weather construction and access is not completely around the perimeter. Although this access has been added, all weather access conditions should be maintained.

6. Section permitting engineer assigned Robeson County is James Wallace - (919) 707-8242 or james.wallace@deq.nc.gov. Be sure to review the approved plans and permits with contractors. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres.
7. Corrective measures are necessary as a result of this inspection. A follow-up compliance inspection may be conducted by Solid Waste Section Staff within about 90 days’ receipt of this inspection report. All corrective actions should be addressed by that timeframe. Failure to meet the conditions for compliance may result in further Compliance Actions.
