PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0405 (a)(10) – RESOLVED OBSERVED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 10 ADDITIONAL COMMENTS 1. The purpose of the visit was to conduct a comprehensive inspection of the Transfer Station. Access roads were of all-weather construction, with fence and lockable gate. Site is no longer taking “mixed recyclables since ~ 9/2023, only MSW. No fires in previous year. Repairs were completed with new scale at entrance, station tipping floor, tin siding of station replaced, and some structural members replaced/reinforced, along with new diverters over loading bay, off from tipping floor. Signage was also addressed since last visit, but it still needs an addition to what’s existing onsite. Per rule, the “waste that can be accepted under the permitted” is to be listed as well. Please add this to your current signage. 15A NCAC 13B .0405 (e)(4) - Signs shall be posted at the site entrances unless otherwise stated in the site permit. The signs shall be constructed of a durable, weather-resistant material. The signs shall be clear and legible to the public. The signs shall state the name of the operator of the site, emergency contact information, the operating hours of the site, the permit number of the current permit authorizing operations at the site, the types of waste that can be accepted under the permit, and that hazardous waste and liquid waste cannot be accepted at the site. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 10 2. Records reviewed back to end of 2023 and additional relevant documents, they included: Random waste screening records, March and August 2024 and monthly waste volumes, operator certifications, station wash down logs, current and previous operations plan, permit and last inspection report, DEMLR NPDES/Stormwater permit, 8 hr. additional training log, fire protection monthly inspection receipt for 8/2024. 8 hr. additional training log should have names/signatures of whom is in attendance, in which it should be the staff working at the facility in which the Ops Plan/Permit they are learning about in the training. Waste screening is now done at 38 tons a day and logged as to meet the new 5% rule. Mr. Hatmaker has previously designed a new log for documenting the screening. The screening is spread out amongst the different companies and truck types. Leachate pumping is being done but only receipts were available. This needs to be organized with a log on dates/times and who is doing the pumping and should be available in future for review during inspections. Certified Transfer Station operators: Leroy Hatmaker expires October 19, 2026; Donna Litteral expires August 24, 2025; Chase Bryson expires August 18, 2025. Additional staff with certifications at other locations managed by GFL are available to work onsite and had copies of their certificate in the file as well. Fire extinguishers are on equipment, inside of office, each corner of station and at the end of the station extended walls around the entrance to tipping floor. These are checked every month by Fire Protection Services in Fayetteville NC. The ones inspected during this visit all had a 2024 inspection tag. A water hose is also available on one corner of the station. Good job. Fire Extinguisher on corner of station. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 10 4. Windblown waste was not an issue in the yard or surrounding the station during inspection. Staff were actively cleaning during inspection. Facility has erosion control fence and the sites security fence which help control windblown. The stormwater pond that has been an issue in the past has some additional fencing and someone is contracted to pick up waste from around the pond periodically, beyond normal windblown pickup. Although there was no leaking leachate into the drain, the onsite discussion consisted of a possible problem in the future with a specific stormwater drain, see photo below. This drain leads to the stormwater pond and is located between that pond and the trailer bay. Discussions were that it is poorly positioned, in regard to the potential leachate runoff from trailer loading bay, staging area, and should a trailer have a leak and be parked in the area. Mr. Powell asked Mr. Hatmaker to discuss with GFLs consultant/engineers, about suggestions on some proactive measures for that specific storm drain, on south side of station. If there was a leaking truck or drain for leachate collection system became clogged in conjunction with stormwater, this could be a conveyance for leachate runoff and discharge into stormwater pond before staff could stop it. Be sure and not alter anything onsite that doesn’t meet DEMLRs requirements, stormwater permit for example but will allow Mr. Hatmaker some options to be more proactive on this potential issue instead of only reactive. 15A NCAC 13B .0405 (b) Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line. A National Pollutant Discharge Elimination System (NPDES) permit may be required prior to the discharge of leachate to surface waters, as provided by 40 CFR 258.26 and 258.27, which are incorporated by reference, including subsequent amendments and editions, and may be accessed at www.ecfr.gov at no cost. (c) - All vehicles and containers being used for the temporary storage of solid waste shall be maintained to be leak-resistant in accordance with Rule .0105 of this Subchapter or shall be stored so that any leachate from the vehicles or containers will be collected to prevent the release of leachate to the environment. The tipping floor seemed to be good during inspection. Behind push walls were mostly clean. Inside the station looked good. The hump along front of the station was improved with the new tipping floor. No odors during inspection. Dust was not an issue. The station is very busy but well organized and controlled. Good job. Trailer storage area looked good; no leaks were visible at backs of trailers. The site usually has a couple cow feeding troughs for stationing behind loaded trailers in case of leaks, but they were all damaged. Please get some devices for replacing these two troughs. Corrective measures are necessary as result of this inspection and should be completed within 45 days receipt of this inspection report sent date. Failure to meet the conditions for compliance may result in further Compliance Actions. No follow up visit is required, and any questions please communicate with David Powell.
