ADDITIONAL COMMENTS
1. David Powell with the Solid Waste Section (Section) met with Marcus Alexander, with American Tire Distributors (ATD), for an inspection. The facility has begun to accept scrap tires in the past months, since pre-op inspection end of last year. Mr. Powell contacted ATD, beforehand, representatives to schedule an inspection with onsite staff. Please remember not all inspections will be announced. This site is permitted to accept scrap tires at their warehouse building, then processes them and is to use a large 18-wheeler container trailers for storing and hauling them to Central Carolina Tire Processing, permit 4308-TIRETP, in Cameron NC. 2. During inspection, Mr. Powell reviewed the permit with Mr. Alexander, along with some of the other required documentation. A copy of permit, recent inspection reports, scrap tire certifications, SDS sheets, emergency exit map, emergency contacts phone list, and a recent fire inspection report, with some violations were eventually compiled and reviewed. It’s understood, from speaking with onsite staff, the violations with the fire inspection report have been resolved and completely addressed. If not, they should be immediately, or this may be an issue. In addition, the onsite documents were not organized, and the operator has not prepared an emergency preparedness manual for the site, as required. General Manager William Smith
was contacted onsite and all discussed permit conditions concerning records. Please compile all required records, into one composition, organized and keep updated as required by permit. The application that was sent in for the permit, and approved, was not onsite and will be emailed again, along with permit and cover letter. All files related to tire collection permit, and what else is mentioned as required per the permit, should be in this one file/manual/binder. This requirement was mentioned last inspection in December 2023.
Permit Attachment 3, Part I, #12 - The following records must be maintained at the facility unless otherwise approved by the Section, and made available to the Section upon request during normal business hours: a. a copy of the permit and approved permit application, b. records of the quantity of scrap tires received at the site, stored at the site, and shipped from the site, including destination (name and address of facility), c. all certification forms applicable to any tires received, stored, or shipped from the site, and d. records of annual fire safety surveys, 15. A fire safety survey shall be conducted annually by local fire protection authorities that accepted
responsibility for fire protection services in the letter submitted with the approved application. [15A NCAC 13B .1107(2)(f)]
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

#17- The operator must prepare and keep an emergency preparedness manual at the site. The manual shall be updated at least once a year, or upon changes in operations at the site. The manual shall contain the following: a. a list of names and numbers of persons to be contacted in the event of a fire, flood, or other emergency, b. a list of the emergency response equipment at the scrap tire collection site, its location, and how it should
be used in the event of a fire or other emergency, c. a description of the procedures to be followed in the event of a fire, including procedures to contain and dispose of the oily material generated by the combustion of large numbers of tires, and d. a listing of all hazardous materials stored on-site, their location, and information regarding precautions. [15A NCAC 13B .1107(2)(i)]

3. Another issue onsite was that tires are not being stored in trailers, as stated in the application, and approved in permit, or on the map provided with the application. They are being stacked and stored in the rear left of the facility, like new tires, and are palleted once they reach approximately 200. Then they are loaded onto a trailer for removal to Central Carolina. Discussions onsite, were that there must have been some miscommunication, from site to site, once they began permitting this and other ATD sites and where the storage would be at each. Because this site staff described that they needed the loading bay area available and didn’t want to waste it on
scrap tires. Owners for this site need to contact DEQ Permitting Section for updating permit/operations plan and maps to suit the onsite operation, if will meet rule, or onsite operations need to align with what’s been approved/rules. Failure to meet the conditions for compliance may result in Compliance Actions. A follow-up inspection in the future will be needed to confirm the corrective actions have been addressed properly. A time frame of 30 days should be sufficient to address the corrective measures listed in this inspection report.
