On November 30, 2023, Ms. Amanda Thompson, representing the State of North Carolina, Division of Waste
Management Solid Waste Section (Section) inspected the above referenced facility. At the time of the inspection,
Section staff observed the burial of land clearing waste in the location of the treatment and processing (T&P)
area, which was outside of the footprint of the land clearing and inert debris (LCID) landfill. A Notice of Violation
(NOV) was sent on December 5, 2023. An extension was granted until April 30, 2024 to remove and process the
buried land clearing waste. A follow-up inspection was conducted on May 24, 2024. Approximately one third of
the waste had been removed and processed and the Section granted a 60-day extension. Another follow-up
inspection was conducted on August 19, 2024 and approximately 40% of the covered waste was remaining in
the T&P area. A Notice of Continuing Violation was sent on August 26, 2024. Ms. Thompson and Mr. Wes Hare,
representing the Section, conducted a follow-up inspection on October 1, 2024. At the time of the October 1,
2024 inspection, no buried land clearing waste was observed in the T&P area. The waste had been excavated,
processed, and taken to another facility for dying and sale.
This letter serves to confirm that the requirements of the Notice of Violation dated December 5, 2023, have
