Permit to Operate will expire April 17, 2025. The Permit Renewal should be submitted to the Section by November 17, 2024. Mr. Gustin anticipates that permit renewal paperwork would be submitted by the end of the week, October 4, 2024. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: A. 15A NCAC 13B .0101 (28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead -based paint." Corrective Action in Progress: The facility was actively removing the countertop material and processing the concrete. Mr. Gustin stated that large pieces of countertop material are set to the side. The smaller pieces of countertop are processed with the concrete, which is then utilized as road bases within the edge of waste markers at landfills. Continue efforts to process and remove the inert debris stockpile from the facility. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA O.paN W Emironm l pu.lily Solid Waste Section B. 15A NCAC 13B .0201 (c), "No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a permit for the facility." RESOLVED: The facility has uncovered and processed the previously identified buried land clearing waste. NOTICE OF VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility entrance is fenced and is secured by a locking gate when it is not open for operation. 2. Correct signage is at the entrance of the facility listing the facility name, permit number, emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday through Friday from 0700 to 1800 and Saturday from 0800 to 1500. 4. The Permit, Operations Plan, and training certificates were readily available; however, were not reviewed during this inspection. 5. A water truck is located at the property and is used, as needed, to control dust emissions at the facility. 6. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(D), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles." The facility is in the process of installing an access roadway around the LCID; however, the roadway was constructed with the comingled ground countertop and concrete material. The facility is in the process of removing the countertop material from the roadway. Continue to establish and maintain access roads around all areas for fire and emergency response vehicles. 7. Some overgrown vegetation was observed on the LCID side slopes. Mr. Gustin stated that the LCID would be mown as soon as the facility dried out from the recent rains. 8. Portions of the LCID side slopes were observed to be steeper than three horizontal to one vertical. Mr. Gustin stated that the facility was in the process of reworking the side slopes to meet the 3:1 ratio. The final grading would then be vegetated. 9. Minimal windblown waste was observed during this inspection. Continue to ensure that windblown is removed prior to the end of the day. 10. Due to the recent heavy rains, several areas of standing water were observed throughout the facility. Mr. Nashwinter stated that the operations areas would be graded to shed water. 11. Ensure that the 100-foot buffer from the property lines are met throughout the facility. 12. Digital pictures were taken during the inspection.
