OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0564 - (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment.
The access around the perimeter of the NLCID was mentioned last inspection, dated 12/5/2023, and access has become much worse. The NLCID is positioned into the corner of an area that was excavated for mining, so basically three sides have slopes, with one side being against the more level and higher elevation, as the NLCID was “built”, with waste acceptance and covering with soil. The lower areas on three sides, where the perimeter road access was previously, is severely eroded in several areas, and there is also ponding stormwater blocking that access outside the EOW, on the NW side. In addition, all access roads should be of all-weather construction to meet rule, 15A NCAC 13B .0566 (7) and should be fixed to meet that rule as well.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. The NLCID is on a property with a large mine, owned and operated by Harris Trucking Inc. The site has a gate, and signage is removed since closing the NLCID to waste acceptance and closure began. No waste being accepted at this time, or in a while, although mine is still active.

2. The side slopes were well shaped and at 3:1 slope, however, erosion rills were visible. Erosion should be addressed ASAP. If closing, keep in mind the ultimate soil depth that is needed to accomplish closure goals as well as current fix of erosion and stabilization. In addition, vegetation has been established across the NLCID.

3. Southern side slope had some minor erosion rills but was vegetated and sloped good. EOW marker was visible on SE corner.

5. EOW markers were previously visible onsite, but only three were visible during this inspection. The SW corner EOW marker was missing, possibly due to severe erosion. All EOW markers should be permanent and visible one to the next. Site needs to be mowed when weather allows. Perimeter road needs to be addressed and of all-weather construction. 6. The NLCID was in the process of submitting documents for closure. However, that was not completed and
there is still an issue, also a violation, with this NLCID/property, in which, property line buffers are not being met per 15A NCAC 13B .0564. Further, Mr. Chris Harris had submitted an image of a Plat Map stamped on 12/18/2023, but it was not the complete map, was not signed by the landowners, or registered with the Richmond County register of deeds. Requests for the required documentation have been made by phone and email from David Powell since last visit. Upon review of Richmond County GIS tax maps, on 9/26/2024 by Mr. Powell, the parcel with the NLCID is still only a 2-acre, PID 842900038311, and the 100-foot buffer to
adjacent property lines is not meeting rule. The violation of the NLCID not meeting the property line buffers must be fixed but the site doesn’t technically have to be closed/permitted until January 1, 2026, per 15A NCAC 13B .0563(6), in which all NLCIDs across the State of NC must be either closed or permitted according to rule. If this issue has been fixed, then please send Plat Map, registered with Richmond County, with all signatures/stamps etc., ASAP to me/NCDEQ. 15A NCAC 13B .0564 (6) Buffer Requirements: A site shall maintain the following buffer requirements: (a) 50 feet from the waste boundary to waters of the State as defined in G.S. 143-212. (b) 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. 7. According to the new LCID Rule 15A NCAC 13B .0563(6), effective January 1, 2021, the notification facilities have to be either closed out or converted into a permitted facility by January 1, 2026. The closure requirements are in the rules, .0567, but here is a generalization:
Once site meets rule requirements, then to finalize closure, the Section requires:
• A cap survey and PLAT map is required to be completed, by a land surveyor, with their name and company name, official stamp and signature, certifying that at least one foot of suitable soil cover has been placed over the entire landfill, utilizing 4 random test holes per acre.
• Photos of test holes, GPS location of each bore hole, also referenced on the cap survey/PLAT map.
• The survey should be recorded with the County Register of Deeds and documentation provided.
• A letter to the Section stating that the owners, “Request closure and have completed the corrective
actions in recent inspections.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner.
• Digital copies of all these items should be emailed to Section/David Powell.
• Post Closure Care will be needed according to Rule 15A NCAC 13B .0567 for ten years following closure. 8. Should Johnny Harris Trucking inc. wish to go forward with total NLCID closure, along with fixing the buffer issue, then please submit the additional required documentation. A follow-up inspection will be needed to confirm all corrective actions and closure activities are completed per rule.
