PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection
STATUS OF PAST VIOLATIONS
None. OBSERVED VIOLATIONS 15A NCAC 13B .0566 (2), “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.” At the time of this inspection waste appears to have been pushed close to the tree line. Some areas of the side slopes were not compacted. The waste needs to be moved away from the tree line and properly compacted, covered, and sloped. 15A NCAC 13B .0566 (3), “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first.” At the time of this inspection, waste on top and at the working faces along the edge(s) of the LCID had been pushed into

the tree line and has not been covered by the rule and the area has grown to be larger than one acre. Ensure that the waste has been moved away from the tree line to the permitted disposal area, covered, and properly sloped.
15A NCAC 13B .0566 (7), “Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.”
At the time of this inspection the access road(s) (with exception of the entrance road) along the edge(s) of the LCID did not have all-weather construction access and was not being maintained to allow access to waste and for firefighting.
ADDITIONAL COMMENTS: This was a compliance inspection visit.
1.The facility signage is posted as required.2.The facility is secured by a locking gate at the entrance of the Barnhill Contracting-Asphalt Plant LCID.3.Most Edge of Waste markers were observed, some are in overgrown / tree lined areas where it was difficult to
understand the limits of waste and the area to be used for access roads around it.4.No all-weather access road was currently present around the LCID.5.No leachate breakouts were observed. The containment basin was full, and it was explained that the basin is
maintained, but rain amounts have been high recently and affect ability to complete work.6.Waste is limited to (permit). Metal bars in concrete sections and rebar were observed. This unacceptable waste should be removed and disposed of properly.7.Cover records were reviewed that showed monthly cover amounts, however, if area(s) will not have additional
wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. All waste shall be covered with no less than six inches of soil monthly or when the active area reaches one (1) acre in size, whichever occurs first. The active area appears to be beyond one acre. Please review Items 21-24 of the permit.8.A site map that delineates the LCID footprint, access roads, and property borders should be available for review during site inspections, and a current copy of the permit. Any operations outside the permitted footprint, and over the maximum acreage must be approved by Permitting prior to expanding beyond the current permitted area.9.Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days’ receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure the issues noted in this inspection report have been addressed. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
