The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. The facility accepts yard waste from residents of Lee County. The incoming waste is periodically ground onsite and either given away to the public or used internally. 2. The access road to the site is of all-weather construction and is currently maintained in good condition.
Signs stating the hours of operation and types of acceptable waste are posted at the facility entrance. 3. The facility operations area appears to be less than two acres in size, but is overgrown with grassy vegetation and small trees, making it difficult to access all areas and determine the facility boundaries. Please mow or rough-cut overgrown vegetation and install durable, easily visible markers delineating the limits of the two-acre notification.
4. NCGS, Article 9, Chapter 130A-309.05 (1), (2), “Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. At the time of this inspection, in addition to an approximate 500 cubic yard pile of unprocessed brush and limbs, several large piles of ground material in various states of decay were observed stockpiled on-site. The
ground material piles were surrounded by and covered with overgrown grassy vegetation and appeared to have been onsite for an extended period. Mr. Symes stated that he was unsure how frequently the material is removed from the facility. Ensure that at least 75% of recovered material is removed from the facility within a calendar year as required by General Statute, and that the facility stores no more than 6,000 cubic yards of material onsite at any given time as required by Rule .1402 (6)(A).
5. 15A NCAC 13B .1402 (g)(2)(F), “for facilities producing compost that is distributed to the public or used in public areas, compost produced from the facility shall meet the pathogen testing and record keeping requirements per Rule .1407(b) and Rule .1408(a) of this Section.” And, 15A NCAC 13B .1406 (10)(b), “The temperature of all compost produced shall be monitored sufficiently to ensure that the pathogen reduction criteria are met.” Temperature records were not available or reviewed during this
inspection. Mr. Symes stated that temperatures of the ground material piles are taken periodically but was unfamiliar with the pathogen reduction requirements. Compost processed at Type I facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) for three days and aerated (turned) to maintain elevated temperatures. Ensure that temperatures are being taken so that the compost or mulch distributed to the public or used in public areas meets the pathogen reduction criteria. Facility owners and operators shall
maintain temperature records for no less than five years. 6. At the time of this inspection, two large pieces of abandoned machinery which appeared to be an old horizontal grinder and a motor grader, were visible among the overgrown vegetation and small trees on the facility grounds. Plastic garbage bags of waste and a large plastic drum full of municipal solid waste were also identified within the trees. Municipal solid waste and litter should be removed from the site and
disposed of by the end of each operating day. It is recommended that the abandoned machinery be removed from the facility and properly disposed of or recycled.
