Solid Waste Director Autumn Romanski - NCDEQ-DWM-SWS-FOB STATUS OF PERMIT: Active: The Permit to Operate shall expire July 14, 2029. Pursuant to 15A NCAC 13B .1401 (c), no later than December 14, 2029, the permittee must submit a request to the Section for permit review and must update pertinent facility plans. • Active Life of Site Permit (PTO) 3301-CDLF-1997 issued on July 14, 2020, and expires December 30, 2057, and combined with New (PTC & PTO) 3301-COMPOST-2020 issued July 14, 2020, and expires July 14, 2030. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .1409 (19) The facility must have a trained operator, in accordance with 15A NCAC 13B .1409 (19), no later than November 1, 2022. A responsible individual trained in facility operations must be onsite during all operating hours of the facility. See Item 2 in the Comments section below. 15A NCAC 13B .1406 (11) Compost time and temperatures must be monitored. See Item 3. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Page of ADDITIONAL COMMENTS: 1) This facility collects and grinds yard waste. The waste can be used as 50/50 alternate cover. 2) The facility became permitted as a Type 1 Compost Facility on July 14, 2020. However, the facility reported discussion with their consultant to start the process of removal of the Type 1 Composting from the permit, as the facility reported that it does not currently have the staff resources to operate in compliance with the permit. 3) The facility is required to have a trained operator onsite during operating hours of the facility. 4) The facility windrows any mulch produced and reported taking temperatures as required. No records were reviewed. 5) Be sure to screen out non-conforming waste. The Solid Waste Section will conduct a follow-up inspection within 30 days of the date of this report, to confirm the status of the facility’s compost training, compost operators onsite, and compost monitoring records. Site staff should be prepared to provide an update on the progress of removing the Type 1 Compost Facility from the permit, if the facility does not intend to operate a Type 1 Compost Facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Page of 15A NCAC 13B .1409 (19) (a) Facilities permitted as a Large Type 1 shall have an operator, supervisor, or manager trained in accordance with the requirements in G.S. 130 A -309.25. No Less than one trained operator, supervisor, manager meeting the requirements of this sub-item shall be onsite during the facility ‘s operating hours or available at a phone number provided in the facility permit. i) Training in accordance with G.S. 130 A -309.25© shall be required every five years. ii) Persons who have achieved and maintain compost operator certification by the US Composting Council Certification Commission or equivalent shall be considered as having met the training requirements in G.S. 130 A 309.25 for the permitted facility. (b) Owners or operators shall provide annual training for facility staff, including a review of the operations plan and permit documents. (c) Documentation of training required in Sub-items (a) and (b) of this item shall be maintained at the facility and made available to the Division upon request. 15A NCAC 13B .1406 (11) Compost process as Type 1 and Type 2 facilities shall be maintained at or above 55 degrees Celsius (131 deg F) for three days and aerated to maintain elevated temperatures.
