Solid Waste Director Autumn Romanski, NCDEQ-DWM-SWS-FOB STATUS OF PERMIT: Active Life of Site Permit (PTO) 3301-CDLF-1997 issued on July 14, 2020, and expires December 30, 2057, and combined with New (PTC & PTO) 3301-COMPOST-2020 issued July 14, 2020, and expires July 14, 2030. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective Action is still in Process. OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES; (f) (2-3) Compaction and cover material requirements. See Item(s) 5, 7, 8 and 9, under Additional Comments. with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS: 1) This Life of Site Permit approves the continued operation of the C&DLF Unit phases 1-9 and 3301-COMPOST-2020. The Permit to Operate for the Edgecombe County C&DLF was recorded in the Edgecombe County Register of Deeds on April 07, 2010 in Deed Book 1551 Pages 645-669. (DIN 10349). 2) This facility is permitted to receive permitted waste generated in the following North Carolina counties: Edgecombe, Nash, Halifax, Wilson, Pitt, and Martin. 3) Facility Certified Landfill Operations Specialist(s): Gloria A. Moseley, expires October 26, 2026 , and (primary operator) Brandon Kelly, expires September 8, 2027, and Jerome McKenzie, expires May 16, 2027. All training records were reviewed the day of the inspection and found up to date. 4) The yard waste area and compost area were observed. 5) The working face appeared to be under ½ acre at the time of this inspection. Cover material was present on the working face; however, compaction activities have been limited due to ongoing equipment operation and maintenance issues. Vegetative growth and erosion stabilization has improved since the last inspection. Leachate breakouts were more controlled and the temporary basin for collecting leachate was mostly dry. A pipe identified during the last inspection that is expected to be the gas system condensate was dry the day of this inspection. Please submit all of the sampling results requested from the wet area(s) identified during the February 27, 2024, Inspection. 6) This inspection was a Comprehensive Facility Compliance Inspection. 7) No leachate was noted outside of the landfill footprint during this inspection. Several areas of liquid identified during the last inspection have dried up, indicating stormwater or groundwater changes during a rainy season may have contributed to the wetness observed in February 2024. One area near the temporary manmade leachate holding basin should continue to be reviewed. The facility should report back to the Solid Waste Section on sampling results of any liquids collected for evaluation. 8) A small amount of leachate is still flowing to the temporary manmade holding basin that was created when the initial leachate breakout was noted (10/07/2021). This area should be pumped as necessary to prevent leachate overrunning the berm and being released from the landfill facility. 9) It is recommended Edgecombe County and/or its consultant, currently Mike Brinchek, continue working with the Section Permitting Branch to discuss remedies for a more permanent solution to the leachate issues at this facility, including concerns of possible groundwater intrusion. 10) A report dated January 12, 2024, and addressed to the Section Permitting Branch provided a summary of the corrective action plan. An update on corrective action plan drawings was due February 29, 2024. Measures continue to be taken to repair the leachate breakouts that have now been going on since found on October 07, 2021, but a permanent solution is still in process. 11) A Notice of Violations was issued on November 17, 2021. A Notice of Continuing Violations was issued upon the findings of the last inspection for not implementing a permanent solution for the temporary manmade holding basin. 13) The landfill had been recently mowed. 14) One monitoring well was observed labeled and locked as required. Groundwater monitoring data was not reviewed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 15) Gloria Moseley, Solid Waste Director should keep Wes Hare and Autumn Romanski informed of all the progress made to resolve the NOV for this facility that is still pending a permanent solution for the temporary manmade holding basin. 16) Digital pictures were taken during this inspection and are included in this report. The Solid Waste Section will conduct a follow-up inspection within 30 days of the date of this report, to review the compaction and cover at the working face. The facility should be ready to provide sampling results of any liquids collected for evaluation from the February 27, 2024, inspection to the Solid Waste Section for review. The facility should be able to show forward progress since January 2024, with the DWM Permitting Unit towards a permanent solution for the temporary manmade holding basin. Equipment maintenance issues were reported the day of the inspection and another operator/observer in this area would help mitigate safety risks and improve management of customers dropping off at the working face. Landfill – side facing the temporary manmade basin/area is still collecting a small amount of leachate from the ongoing breakout. Areas and trough along the back of the landfill observed wet at the last inspection have dried up and the stormwater pond was dry the day of this inspection. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 7 of 7 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES (f) Compaction and cover material requirements. Solid waste shall be managed within the disposal area throughout the life-of-site and post-closure care period to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. The owner or operator shall comply with this requirement using the following compaction and cover procedures: (1) The owner or operator shall compact the solid waste. (2) Except as provided in Subparagraph (4) of this Paragraph, the owners and operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly. Cover shall be placed at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule. (3) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph. (4) Alternative materials or an alternative thickness of cover are allowed with prior approval of the Division if the owner or operator demonstrates that the alternative material or thickness prevents the escape of waste and the attraction of vectors and scavenging, and minimizes fires and the generation of odors without presenting a threat to human health and the environment. Alternative materials that have been approved by the Division for use at any C&DLF may be used at all C&DLFs in accordance with G.S. 130A-295.6(h1).
