NOTICE OF VIOLATIONS: A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including finished product." RESOLVED: During this inspection, it was determined that the facility had processed and removed enough waste to be below the 6,000 cubic yards allowed onsite at any given time. Continue to ensure that no more than 6,000 cubic yards of material are onsite at any given time. B. 15A NCAC 13B .1406 (8), "Reporting Fires. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident." OBSERVED VIOLATIONS A. 15A NCAC 13B .1404 (a)(2), "A 100-foot buffer shall be maintained between all property lines and compost areas for Type 3 and 4 facilities, 50-foot for Type 1 or 2 facilities." RESOLVED: During this inspection, it was identified that the waste has been moved away from the property boundaries. A wide access roadway has been installed around the land clearing stockpiles to ensure that the waste is away from the property boundaries. B. 15A NCAC 13B .0103 (e), "No person shall dispose or cause the disposal of solid waste in or on waters in a manner that result in solid waste's entering waters or being deposited upon lands of the State." RESOLVED: The previously identified wood waste, ash, and concrete have been removed from the edges of the sediment basin. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility accepts stumps, whole trees, limbs, and branches. 2. The facility is secured by a locking. Vehicles must pass over the scale to enter and leave the facility. 3. The facility utilizes a tub grinder to grind the wood waste at a minimum of twice per year. The on -site tub grinder was actively being repaired during this inspection. 4. The waste located at the facility was measured to be below the maximum 6,000 cubic yard limit. Hunter stated that the facility would not advertise to accept waste but would continue to process and remove the waste. Once all of the waste is removed, the facility would resume operations with a clean slate. 5. A new access roadway has been installed at the facility. The access roadway has been graded to shed water away from the stockpiles. 6. No areas of standing water were observed. Continue to ensure that the area is properly graded to shed water. 7. The waste stream was relatively clean. Unacceptable wastes are removed from the waste stream as they are observed. A roll -off container is located on -site for unacceptable wastes. 8. A concrete crusher was recently delivered to the facility to start processing the concrete stockpile. The crushed concrete would be utilized on the access roadway for the facility and/or sold. 9.
