This permit shall expire on November 5, 2024. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code 13B .0203(d) states: permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the Part VI, Permit Condition #12 of the approved Permit to Operate states in part: This facility is permitted to receive Household Hazardous Waste (HHW) generated within Ashe County. To qualify as HHW the waste must be: (a) During the previous inspection, multiple Customer Registration Forms were observed documenting HHW had been received from businesses in violation of 15A NCAC 13B .0203(d) and Part VI, Permit Condition #12. To achieve compliance, Ashe County was required to ensure that the facility only accept HHW generated by residential households. Please continue to work with facility staff to ensure only waste generated by residential households is accepted. OBSERVED VIOLATIONS: No new violations observed. ADDITIONAL COMMENTS 1. The facility is permitted to receive Household Hazardous Waste (HHW) from Ashe County only. 2. The facility is closed on Sundays, Tuesdays, Wednesdays, and Holidays. 3. A site attendant was on duty while the facility was open to the public. 4. The facility also serves as a convenience area for the collection of used oil, oil filters, vehicle batteries, cardboard, aluminum and metal cans, glass, plastics, and scrap tires. 5. A gate was provided at the entrance to the facility to prevent unauthorized access when closed to the public. The facility is also surrounded by a chain-length-fence with three strands of barbed wire at the top. 6. The facility had proper signage. 7. The Permit to Operate and Operations Plan were current and available upon request. 8. Ashe County provides annual training for site attendants. Training certificates were maintained in the site attendant building and indicated training was last completed January 8, 2024. 9. A Customer Registration Form is completed for each load of HHW received at the facility. These forms verify the type and amount of waste received, and confirm the waste was generated from a household in Ashe County 10. All HHW is stored in a steel, trailer-type structure with three separate compartments. The first compartment (left to right) is designated for storage of oil-based paint and flammable liquids. The second compartment is designated for the storage of latex paint, and the third compartment is designated for storage of insecticides, pesticides, and antifreeze. All compartments were well maintained. Secondary containment was provided within the floor of each compartment. 11. Pad locks were in place on each compartment door to prevent access with the facility is closed. 12. Facility safety equipment is inspected each operating day. Records were maintained at the site attendant building. Equipment inspected included gloves, hard hat, aprons, mask and cartridges, and the eye wash station. 13. The HHW facility was equipped with a dry chemical suppression system. 14. Drums used for the collection of HHW were clearly labeled with the date each period of accumulation began. 15. All observed sump outlets leading from the secondary containment were capped at the time of inspection. 16. A metal building is provided for the collection of florescent bulbs. All bulbs were packaged in designated carboard containers for shipment to the vendor at the time of inspection. 17. A covered trailer is provided on site for the collection of scrap tires. No trailer was on site upon arrival as tires had been removed from the site prior to inspection. An empty trailer was delivered to the site prior to the end of this inspection. 18. Used oil is collected in an above ground storage tank adjacent to the site attendant building. 19. Used oil filters are placed in a 55-gallon drum adjacent to the above ground storage tank designated for used oil collection. 20. Access around the facility was free of obstacles and well maintained. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
