The most recent Yard Waste Notification was submitted to the Section on May 5, 2024.
PURPOSE OF SITE VISIT:
Follow-up Compliance Inspection
NOTICE OF VIOLATIONS
A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in
size and shall be limited to more than 6,000 cubic yards material onsite at any given time, including finished
project."
RESOLVED: During this inspection, the yard waste at the facility was actively being processed. The processed
yard waste was placed in windrows and removed from the facility. The processed yard waste was being taken to
several farmers in the area for utilization as a soil amendment. Mr. Chalker sent Ms. Thompson a photograph on
September 9, 2024, which depicted all of the yard waste had been ground and removed from the facility. Continue
to ensure that the waste is processed and removed as needed to ensure that no more than 6,000 cubic yards of
vegetative material is located at the facility.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Correct signage is posted near the gated entrance. The gate was open during this inspection.
2. There are trash cans at the site for all unacceptable wastes that come in with the leaves and other yard trash. No
unacceptable wastes were observed during this inspection. Good Job! Continue to ensure that unacceptable wastes
are removed as necessary.
3. During the processing of the waste at the facility, the entire operating area had been regraded to shed water. One wet
area was observed near the center of the southern edge of the finished compost area. Mr. Chalker stated that area
would be regraded so that this wet area would be the drainage swale to ensure that there is no standing water within
the operations area. Continue to regrade as necessary to prevent ponding water.
