STATUS OF PERMIT:
A Permit Approval to Construct MSW Landfill Phase 5 and a Permit Approval to Operate MSW Landfill Phases 1 4
and Phase 5, Cell 6 and a Landfill Gas to Energy System was issued to Caldwell County (Owner) and Republic
Services of North Carolina, LLC (Operator) d.b.a Foothills Regional Landfill on March 22, 2024.

OBSERVED VIOLATIONS:
None
ADDITIONAL COMMENTS
1. The facility consists of a lined MSWLF, Tire Management Area, White Goods Area, and a Mulching and Grinding
Area.
2. This was a partial inspection to evaluate the operations of the facility.
3. The facility had proper signage.
4. A gate was provided at the entrance to the facility to prevent unauthorized access.
Operations Inspection of the MSWLF Unit:
5. Waste as being placed in western portion of Cell 6B at the time of inspection.
6. The working face was small and compact. The size of the working face had been greatly reduced from what was
observed during previous inspections. Thank you for your efforts to reduce the size of the working face.
7. One tipper was in use at the time of inspection.
8. No unacceptable waste streams were observed.
9. Windblown waste was well controlled.
10. A separate disposal area was being used for the disposal of small residential loads located west of Cell 6B.
The working face was very small and compact.
Majority of waste was covered with Posi-Shell which had been well applied.
No unacceptable waste streams were observed.
11. Inactive portions of the landfill to include side slopes were well covered with soil. Mr. Pinner stated inactive areas
not already stabilized with vegetation had recently been seeded. Some germination of seed was observed on side
slopes west and north of Cell 6B. Continue efforts to stabilize all disturbed areas with a groundcover sufficient to
restrain erosion.
12. Edge-of-liner markers were in place around the perimeter of the landfill with the exception of the northern
perimeter of Cell 6B. Please ensure markers are provided around the entire perimeter of the landfill.
Operations Inspection of the Tire Collection Area:
13. Tires were being collected in multiple covered trailers located west of the scale house.
14. All tires were being maintained within the designated trailers at the time of inspection.
Operations Inspection of the White Goods Collection Area:
15. White goods containing chlorofluorocarbons (CFCs) are collected on a concrete pad located west of the scale
house and adjacent to the tire collection area.
16. All white goods containing CFCs observed were stored in an upright condition to ensure the integrity of the
appliances prior to removal of CFCs.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Operations Inspection of the Griding Area:
17. The grinding area is located south of the landfill and just east of the leachate tanks.
18. A large stockpile of unground wood waste was observed on site at the time of inspection.
19. One plastic pole, a piece of painted plywood, one glass jar, and one piece of unpainted plywood were observed
within this area. Please ensure all unacceptable materials are removed and properly disposed of. If any material
cannot be safely retrieved, please ensure any unacceptable material observed is removed for proper disposal during
the grinding process.
Supporting Comments:
20. Leachate tanks were observed.
Leachate was shown to be 2-feet in both tanks.
No concerns were observed with the secondary containment area surrounding the tanks.
21. All access roads were of all-weather construction and well maintained.
