In the event of noncompliance with the permit, the owner or operator shall minimize the release of waste, leachate, or contaminants to the environment, and shall prevent adverse impacts to human health or the environment.” Resolved FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20240822 Page 2 of 5 4) 15A NCAC 13B .0405 (a) states “The owner or operator of a transfer station (site) shall maintain and operate the site in accordance with the operations plan incorporated into the permit by Rule .0404(d) of this Section…” Resolved 5) 15A NCAC 13B .0405 (a) (6) states “Erosion and Sedimentation Control Requirements. The site shall comply with 15A NCAC 04, and the owner or operator shall utilize erosion and sedimentation control measures that prevent sediment from leaving the site and prevent on-site erosion.” Resolved 6) 15A NCAC 13B .0405 (a) (10) (B) states “…The site shall prevent waste from being blown outside the waste handling areas by the wind, using methods such as: providing skirts, such as rubber belting or brushes, around the top of chutes to minimize the space between the chute and the hauling trailer at sites with chutes and hoppers;” Resolved 7) 15A NCAC 13B .0405 (a) (11) states “Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. The tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of the site building including side walls and any material storage areas outside of the building shall be cleaned with a pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be contained and treated as leachate. Cleaning and maintenance records shall be maintained and made available to the Division upon written request.” Resolved OBSERVED VIOLATIONS: There were no violations observed during this inspection, please see the ADDITIONAL COMMENTS section below for details concerning this inspection. ADDITIONAL COMMENTS: 1) This facility is permitted as a Solid Waste Transfer Facility; all operations shall be in accordance with the North Carolina Solid Waste Management Rules, 15A NCAC 13B; Article 9 of the Chapter 130A of the North Carolina General Statutes and is permitted to receive Solid Waste as defined in NCGS 130A-290(a)(18)(a). 2) Hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, regulated asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, infectious waste, animal carcasses, radioactive waste, septage, fluorescent and high-intensity discharged lamps, ashes/incinerated residues, and wastes banned from disposal in North Carolina by NCGS 130A-309.10(f) are prohibited from being accepted at this facility. 3) This facility may receive solid waste generated within Beaufort, Bertie, Craven, Chowan, Hyde, Martin, Pamlico, Pitt, Tyrrell, and Washington Counties. 4) All received waste is transported to either the East Carolina MSW Landfill, permit #08-03 in Windsor, Bertie County, NC; the Upper Piedmont Regional Landfill, permit #73-04, in Rougemont, Person County, NC; or the Brunswick Waste Facility, permit #583 in Lawrenceville Virginia. 5) Daily operations at this facility are conducted by contract with Trio Legacy, LLC of Pantego, NC. 6) Proper signage including the facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the facility entrance. 7) The hours of operation are Monday through Friday 7:00 AM to 3:45 PM and Saturday 7:00 AM to 12:30 PM. Three Holidays are observed: New Year’s Day, Thanksgiving Day, and Christmas Day. 8) The facility is secured by means of a locked gate at the facility entrance. The gate was unlocked and open The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as ma be necessar to achieve com liance with the North Carolina Solid Waste Mana ement Act and Rules. Facility attendants were on site during this inspection. 9) Facility cover crop repairs are ongoing. Much of the equipment traffic damage noted in the last inspection has been repaired. The area of sparse cover and erosion is now restricted to the area immediately to the south of the transfer facility. *Please continue working to establish a groundcover suitable to prevent erosion in all vegetated areas of the facility. Equipment traffic should be restricted to the paved and gravel travel corridors and off-road traffic should be minimized. 10) There are two hose-bibs, one located at the front corner of the transfer station and one located at the loading bay exit for wash-down and fire suppression. 11) There are five fire extinguishers on site for fire control: three are located in the transfer station, one in the loader, and one in the cab of the trailer transport tractor. 12) There were eight loaded transfer trailers on-site at the time of my arrival; all loaded trailers were tarped and staged for transport to the landfill for final disposal. *Please continue working to ensure all loaded trailers are properly tarped/covered upon removal from the trailer loading bay. 13) There were three empty transfer trailers on-site at the time of my arrival. 14) This facility maintains a John Deere 310SK Loader, a John Deere 310D Loader, and a John Deere 936E Loader on site for facility operations and maintenance. 15) Windblown debris is well managed at the is time. No windblown materials were observed along the perimeter fence or loose around the property. Facility personnel were on site collecting windblown debris from around the immediate vicinity of the loading bay entrance and exit upon my arrival. 16) All incoming waste is being dumped and managed on the concrete pad inside the transfer station. *Please continue working to ensure all incoming waste is deposited on the tipping floor and maintained within the covered Transfer Station until loaded into transfer trailers. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20240822 Page 4 of 5 17) The waste type was reviewed; no unpermitted waste types were observed on the tipping floor during this inspection. 18) The missing/damaged loading bay overhead panels have been replaced. 19) The loading bay directional chutes have been damaged/bent and are currently in a near vertical position, resulting in an excessive volume of overflow debris during the workday. *Within thirty days of receipt of this facility compliance inspection report, plans need to be underway for the repair of the loading bay chutes. Moving forward, any damage to the facility should be repaired as soon as possible. 20) The leachate drains were clear of blockage during this inspection and appear to be functioning normally. 21) The trailer loading bay is cleaned of overflow materials as needed throughout the workday and at the end of each workday. *Please continue working to ensure the trailer loading bay is policed of overflow debris at the FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 0703T_INSP_20240822 Page 5 of 5 end of each workday or more often as needed to prevent the creation of a nuisance. 22) *Continued corrective measures are required as a result of this inspection report.
