Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All photographs were taken by Lee Hill on August 20, 2024, unless otherwise noted. 2. The facility entrance is secured by a gate and a portion of the facility is fenced to prevent unauthorized access. In areas where fencing has not been installed, topography serves to limit access as well. 3. Signage was installed at the entrance to the facility showing the hours of operation, permit number, disposal procedures and that hazardous and liquid waste is not accepted. 4. The access roads were constructed of all-weather material and were being maintained at the time of inspection. Records Review 5. The permit and operations plan were available upon request. 6. Waste screening records were available for review for the period of October 3, 2023-August 19, 2024. The facility is conducting two random waste screenings per operating day; however, the forms do not state the final disposition of unacceptable material. Ensure that the forms record what is done with any unacceptable material that found. 7. North Carolina Certified Landfill Manager • John Preston (expires April 26, 2027) 8. Landfill gas monitoring was being performed as required by 15A NCAC 13B .1626(4). According to facility records, gas monitoring was conducted on February 26, 2024, May 10, 2024, and July 2, 2024. No exceedances were observed. 10. Tonnage records were reviewed from the FY 2023-24 Facility Annual Report. The facility received 177,119 tons of waste from July 1, 2023, to June 30, 2024, including 16,562 tons of exempted waste. 11. Leachate is transported to either the Town of Maggie Valley wastewater treatment plant or the Town of Waynesville wastewater treatment plant for disposal. Facility records indicated 2,791,460 gallons of leachate were sent for treatment from January 2024 to August 2024. 12. Asbestos disposal records were available for review upon request. 13. Leachate collection lines were inspected by camera on April 18, 2024. Operations Inspection of the MSWLF Unit (4407-MSWLF-1993) 14. The facility was filling in Cell 5A at the time of inspection. 15. All observed windblown waste was confined to the cell area. 16. The facility was filling on the north side of the cell, adjacent to a section with grass and soil cover. It appeared that the soil may not have been fully removed down to the waste layer before filling. It is recommended that all cover material be removed from the waste before filling to ensure that leachate migrates vertically rather than horizontally, reducing the risk of future leachate seeps. 17. Waste was observed on the west side of the landfill cell, on top of a well -covered soil layer. It appeared that the waste had been deposited there due to machinery movement across the top of the cell. Restricting equipment movement to a smaller area near the working face will help prevent waste from being tracked onto covered material. Facility staff later sent photographs showing that the area had been cleaned up. 18. No unapproved material was observed on the working face at the time of inspection. 19. Waste was observed on and around the stabilizer "wings" on the trailer tipper. Ensure that all waste is covered at the end of each operating day as required by 15A NCAC 13B .1626(2)(b). 20. The side slopes of Cells 1-5 had well -established vegetative cover, with no erosion issues observed. 21. Edge of waste (EOW) markers, constructed of wooden posts were installed around the perimeter of the cells as required. 22. All observed monitoring wells were locked and had identification plates attached. 23. The leachate pond had adequate freeboard and no visual deficiencies were observed in the exposed portion of the liner. The Mulching and Grinding Treatment and Processing Area is located east of Cell 2. During the inspection, a small amount of ponding water was observed in front of the unground stockpile, likely from a recent rain event. The area should be graded to ensure proper drainage and to prevent the possibility of water accumulating in the stockpile. 25. One piece of engineered wood was observed in the stockpile. Remove any unapproved waste from the stockpile and dispose of properly. Please contact me if you have any questions or concerns regarding this inspection report.
