The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. The purpose of this inspection was to conduct a comprehensive inspection of the notification and other permitted sites at this location for Richmond County. The site is also the location of Temporary Disaster Debris site DS77-002 and is not currently activated. A YWN renewal for 2024 has been submitted. Currently the notification is
only being used for leaf and one straw wastes, only during emergencies would it be used for additional storage, according to Mr. Leggett. This visit to Richmond County was also for inspections of an Air Curtain Incinerator (T and P) on the other side of property, which is the new way of managing the yard waste. It should be noted that a previous meeting involving Richmond County Bryan Leggett and Jerry Austin, along with Smith and Gardner Mike Brinchek, Solid Waste Section staff Jason Watkins, Andrew Hammonds, Sherri Stanley, and David Powell was conducted on 5/24/2023 virtually, to discuss a proposed LCID landfill in the area near, and possibly including the YWN. The YWN part of this meeting resulted in an agreement that Richmond County will submit a Corrective Action Plan to the Section for managing all the new waste onsite, as well as identifying a “good faith effort” in addressing the older yard waste remaining in the yard waste notification. The Corrective Action Plan (CAP) was received by Section on 5/30/2023. All new waste should be utilized according to rule, and the older waste should continue to be utilized according to rule, in a good faith effort, until a permit/approval
from the Section permits an alternative or the waste is removed down to soil. 2. It was previously understood the ACI will take the flow of new yard waste and the YWN will not receive any
waste, so that the older and newer wastes at that location can be removed without continuing to lose ground to even newer wastes interfering with the site’s cleanup. The operation has now changed. Removal has slowed in recent months due to staff have vacancies and sicknesses, which has delayed the removal of the older wastes.
Hauling has begun again with Mr. Leggett prioritizing the newer waste to be hauled while still attempting older waste hauling. Once caught up with newer waste, more time can be spent on older waste removal. Once older wastes at the notification are removed down to clean soil, then the operation can shift for any new waste over to that area. This will allow it to not inhibit the operation, as well as, older waste removal moving forward. Currently, with what’s onsite and any new waste, the county needs better separation/windrows with the wastes, buffering between windrows and around the perimeter to meet rule, and provide firefighting and inspection access. Please address when weather allows. All roads should be all weather construction. Waste is still being soaked in leachate then hauled away to assist managing the standing leachate. Mr. Leggett has also added some diversions, water control type structures in the access roadway, up gradient to the YWN to assist with stormwater diverting from the YWN. Site has not grown beyond previous limits. 3. Records reviewed included, renewal, notification, previous time and temps, previous inspections and permit. Time and temperatures not being recorded since waste is either going to ACI or being hauled from YWN to Uwharrie landfill for ADC. It may be necessary for facility staff to pump and haul the ponding leachate to
prevent a release. County can manage this leachate in liquid form as pumping and hauling or it can use mulch to sponge some of the leachate and then dispose of the waste in transfer station. Develop a plan of action for addressing stormwater coming onto the notification and preventing this organic leachate creation. Areas impacted by the leachate may require an assessment. 15A NCAC 13B .1406 (4) - Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters. 4. Some Edge of Waste (EOW) markers were present and represent the limits that are being used currently. However, they need to be reinstalled in the correct locations once work onsite is completed. Be sure the accurately mark the 2 acre or less notification as well as comply with buffers.
