PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: Observed violations from previous February 8, 2017 inspection remain unresolved and are listed below. OBSERVED VIOLATIONS: A. 15A NCAC 13B .0566 (1), “The site shall only accept those solid wastes that it is permitted to receive.” At the time of this inspection, unacceptable wastes such as scrap metal, painted and unpainted dimensional lumber, plywood, sheetrock, insulation, and a metal and plastic traffic barricade were observed within the LCID. This facility is permitted to accept land clearing debris and inert debris only. Ensure that all unacceptable wastes are removed and disposed of at a facility permitted to accept such wastes. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 B. 15A NCAC 13B .0566 (2), “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.” The eastern and northern slopes of the landfill contain significant amounts of uncovered waste and exceed a ratio of 3:1. Ensure that side slopes are adequately covered with soil and properly graded. C. 15A NCAC 13B .0566 (3) & (4), “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material.” The area of exposed waste, including the side slopes, exceeded 1 acre in size and appeared to have not been covered with soil within the one-month period. Piles of uncovered brush and stumps had been dumped along the access road and outside the approved 2-acre landfill footprint. Ensure that all exposed waste is covered by a minimum of six inches of soil, sloped to shed surface water, and stabilized with vegetative ground cover. No waste shall be dumped or disposed of outside of the 2-acre notification. D. 15A NCAC 13B .0566 (9), “Solid waste shall not be disposed of in water.” At the time of this inspection, ponding water containing waste was observed along the base of the eastern side slope. Ensure that all side slopes and low-lying areas of the landfill are graded to direct surface water away from the landfill and prevent ponding. ADDITIONAL COMMENTS In accordance with 15A NCAC 13B .0563 (6), by January 1, 2026, all owners or operators of a notified LCIDLF shall close the notified LCIDLF in accordance with Rule .0576 (b) or obtain a permit from the Solid Waste Section. Please submit an application to obtain an individual LCID permit prior to July 1, 2025. 1. 15A NCAC 13B .0566 (14), “A sign shall be posted at the site entrance showing the site contact's name and phone number, emergency contact information, and the waste types accepted for disposal at the site.” Please post a sign at the site entrance stating the types of waste accepted for disposal at this site. 2. The facility is secured by a metal gate with a lock. However, the gate was overgrown with vegetation and appeared to have not been closed in some time. A locked gate can be an effective deterrent to unauthorized dumping. Ensure that the gate is free of vegetation, operational, and utilized to secure the facility when not in use. 3. The access road is of all-weather construction. 4. At the time of this inspection, the side slopes of the LCIDLF were overgrown with a combination of tall grassy and woody vegetation. Ensure any trees or woody vegetation are removed or rough cut, and that grassy vegetation is mowed as often as necessary to allow for visual inspection of the landfill. 5. 15A NCAC 13B .0564 (6)(b), “A site shall meet the following buffer requirements: 100 feet from the waste boundary to property lines…” The eastern and northern edges of waste appeared to be encroaching on the required 100 buffer from adjacent property lines. Ensure that edge of waste (EOW) and property line with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 markers are established at this facility so as to be clearly visible during inspections. Any waste within the buffer must be pulled back and placed within the limits of the LCIDLF. 6. Corrective measures are necessary to bring this facility into compliance and should be completed within 60 days of receipt of this inspection report. The Solid Waste Section will conduct a follow-up inspection in 60 days to ensure the issues noted in this report have been addressed. 7. Digital photographs were taken during this inspection.
