STATUS OF PAST NOTED VIOLATIONS:
No violations noted on the previous inspection.
OBSERVED VIOLATIONS:
1) A 2,500-gallon concrete tank had been used for storage of septage prior to being inspected or
permitted. This is a violation of Rules 15A NCAC 13B .0838(s) and .0837(q). Rule .0838(s) states
"Septage shall not be stored or treated at a new septage treatment or detention facility until a
representative of the Division has inspected the facility to determine compliance with these Rules
and consistency with the permit application and all permit conditions." Rule .0837(q) states
"Applications for permit modifications shall be required for the following changes: (1) property
ownership; (2) treatment methods; (3) types of septage to be stored or treated; or (4) size and
number of treatment or storage structures." See "Additional Comments" for more information.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Access road to the tanks is well maintained as per Rule 15A NCAC 13B .0838(b).
2) "No Trespassing" signage at gate entrance to facility as per Rule 15A NCAC 13B .0838(k).
3) There were 2 above ground poly tanks, 1 buried 3,500-gallon concrete tank, and 1 above ground 2,500-
gallon concrete tank. The above ground tanks were accessible for inspection as per 15A NCAC 13B
.0838(i).
4) The 2,500-gallon concrete tank is not currently permitted. However, it was being used to store septage.
As noted above in "Observed Violations," the use of the 2,500-gallon concrete tank to store septage is a
violation of Rules 15A NCAC 13B .0838(s) and .0837(q). An application was submitted on 07/16/2024 for
the renewal and modification (adding 2,500-gallon concrete tank) of the permit. There were no leaks
notice from the 2,500-gallon concrete tank.
5) No holes or cracks observed in the other tanks which may allow the escape of septage out of the tank as
per Rule 15A NCAC 13B .0838(c). No leaks noticed. Billy mentioned that the 7,000-gallon plastic tank
had developed a crack and that they were in the process of removing this tank. Still some grease
septage left in the tank. Please notify me when the tank is empty.
6) Some paper from portable toilet waste spills noticed on the ground around the buried 3,500-gallon
concrete tank. Please clean up the waste and make every effort to prevent the spillage of septage onto
the ground when transferring septage to and from the tanks as per 15A NCAC 13B .0838(j).
7) No vector or odor issues noticed as covered within Rules 15A NCAC 13B .0838(e)(2) and .0838(g).
8) No change noticed that would affect setback distances. The 2,500-gallon concrete tank was placed next
to the buried 3,500-gallon concrete tank.
