PURPOSE OF SITE VISIT: Compliance Inspection NOTICE OF VIOLATIONS A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to more than 6,000 cubic yards material onsite at any given time, including finished project." During this inspection, the large unground vegetative waste stockpile was measured to be approximately 115 yards long by 29 yards wide by 3 yards high, which is approximately 10,005 cubic yards of material. Five windrows of ground vegetative waste were observed in the western end of the operating area. Each of the ground vegetative waste piles were measured to be approximately 68 yards long by 3 yards wide, by 3 yards high, for a total of 612 cubic yards each. The estimated total for the ground vegetative waste piles is approximately 3,060 cubic yards. This is over the allowed 6,000 cubic yards of unground material and finished product. OBSERVED VIOLATIONS: None. Page 1 of 3 NORTH CARnLINAD_E Q�� o.n.mm.m m c.w.mmen.i a.i� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Correct signage is posted near the gated entrance. The gate was open during this inspection. 2. There are trash cans at the site for all unacceptable wastes that come in with the leaves and other yard trash. Several pieces of painted lumber were observed in the eastern end of the unground vegetative waste pile. Any painted or treated dimensional lumber and other unacceptable wastes encountered need to be removed and properly disposed of prior to the grinding of the waste. 3. Two separate areas of organic leachate were observed between the western end of the unground vegetative waste pile and one of the ground vegetative waste piles. The organic leachate was contained within depressions and did not appear to have left the facility. The yard waste area needs to be graded to properly shed water from the operating area. 4. Edge of waste markers were visible from one to the next, around the yard waste notification, 5. Digital photographs were taken during the inspection. 6. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. Please contact me if you have any questions.
