NOTICE OF VIOLATIONS:
A. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section
.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The
markers shall be of height and spacing so that they are distinguishable from the surrounding landscape,
and so that the adjacent markers are visible when standing at a marker."
During this inspection, no edge of waste markers were observed. This was commented on in the inspection
reports. The surrounding forested area had been clear cut, which made the landfill footprint difficult to identify

from the surrounding cleared area. Edge of waste markers must be installed at the facility to delineate the
waste disposal boundaries.
B. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall maintain the following buffer
requirements: ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or
public buildings, and potable wells." As identified in previous inspection reports, it appears that the LCID
occupies Parcel 0920408 (1.99 acres in size), which is landlocked by Parcel 0909002. At the time of this
inspection, Parcel 0909002 had been clear cut. The waste at the facility must be 100 feet from the property line
of Parcel 0920408. In order to meet the buffer requirements, P.C. Lutter III and Emily Luter (Property Owners)
can combine the two parcels, 0920408 and 0909002, or Mr. Conner can move the waste away from the property
line to meet the 100-foot setback.
C. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of
three horizontal to one vertical at any time." Due to the clear cutting of the surrounding forested area, it was
difficult to identify the actual working face. The landfill footprint needs to be delineated so that the working face
can be identified and properly compacted, covered, and sloped. This was identified as an observed violation in
the November 2022 and October 2023 inspection reports. The working face and side slopes must be compacted,
covered, and graded so that the slope is no steeper than 3: 1.
D. 15A NCAC 13B .0566 (3), "All waste shall be covered with a minimum of six (6) inches of soil monthly, or
when the working face reaches one (1) acre in size, whichever occurs first." Due to the clear cutting of the
surrounding forested area, it was difficult to identify the actual working face. The landfill footprint needs to be
delineated so that the working face can be identified and properly covered with a minimum of six (6) inches of
soil. This was identified as an observed violation in the November 2022 and October 2023 inspection reports.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. As a reminder, based on rule 15A NCAC 13B .0563 (6), the notified LCID landfills will need to be properly
closed or obtain a permit from the Division of Waste Management by January 1, 2026.
2. The facility is secured by a locking gate.
3. 15A NCAC 13B .0566 (14), "A sign shall be posted at the entrance showing the site contact's name and
phone number, the permit number, emergency contact information, and the waste types accepted for
disposal at the site." No signage was posted at the entrance of the site. This has been commented on in previous
reports.
4. No unacceptable wastes were identified within the waste stream.
5. Digital pictures were taken during the inspection.
6. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up
inspection in 30 days to ensure issues noted in this inspection report have been addressed.
