OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states: "By receiving solid waste at a permitted facility, the permittee shall be considered
by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit."
General Permit Condition #6 states: "Construction and operation of this solid waste management facility must be
in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North

Carolina General Statutes (NCGS 130A-290, et seq), the conditions contained in this permit; and the approved plan.
Should the approved plan and the rules conflict, the Solid Waste Management Rules shall take precedence unless
specifically addressed by permit condition. Failure to comply may result in compliance action or permit revocation. "
The approved Operations Plan for the facility states under Section 5.18.2 "Waste Cover": "Waste cover
comprised of 6 inches of compacted soil will be placed on the landfill working face and other exposed waste
at the end of each operating week, or when the disposal area exceeds one-half acre in size. If conditions
warrant (such as adverse weather or excessive wind), cover will be applied at more frequent intervals. Cover
will also serve as a firebreak. Removal of cover prior to waste placement will only occur during normal
weather conditions. Removal of cover will not occur during periods of high winds or heavy precipitation.
The cover removed prior to waste placement will be stockpiled adjacent to the working face. "
During the inspection, uncovered waste was observed on all landfill side slopes and on the top of Phase 3B. Exposed
waste was observed in rills and on the surface of the landfill. The last date waste was received in Phase 3B was on
March 9, 2024. Therefore, Lake Norman Landfill, Inc. is in violation of 15A NCAC 13B .0203(d). To achieve
compliance, all exposed waste must be covered with a minimum of 6-inches of earthen material in accordance with
this rule.
B. 15A NCAC 13B .0542(f) states in part: "Compaction and cover material requirements. Solid waste shall be
managed within the disposal area throughout the life -of -site and post -closure care period to prevent the escape of
waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. The owner or
operator shall comply with this requirement using the following compaction and cover procedures:
(3) Areas that will not have additional wastes placed on them for three months or more, but where final
termination of disposal operations has not occurred, shall be covered and stabilized with vegetative
ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph. "
During the inspection, uncovered waste was observed on all landfill side slopes and on the top of Phase 3B. Exposed
waste was observed in erosion rills and on the surface of the landfill. Areas of Phase 3B were not covered and
stabilized with vegetative ground cover. The last date waste was received in Phase 3B was on March 9, 2024.
Therefore, Lake Norman Landfill, Inc. is in violation of 15A NCAC 13B .0542(f)(3). To achieve compliance, Phase
3B must be covered and stabilized with vegetative ground cover or other stabilizing material in accordance with this
rule.
C. 15A NCAC 13B .0542(k) states: "Erosion and sedimentation control requirements. Erosion control measures
consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the
site and to prevent on -site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including
subsequent amendments and editions. "
During the inspection, deep erosion rills were observed on all landfill side slopes in Phase 313, exposing waste.
There was not sufficient vegetative ground cover or other stabilizing material in place to prevent erosion. Therefore,
Lake Norman Landfill, Inc. is in violation of 15A NCAC 13B .0542(k). To achieve compliance, erosion control
measures must be utilized to prevent silt from leaving the site and to prevent on -site erosion in accordance with this
rule.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Proper signage was observed at the entrance of the facility.
2. The facility is permitted to receive solid waste within approximately 100 miles around the landfill.
3. The last date waste was received in Phase 3B was on March 9, 2024. This Phase is inactive.
4. Several acres in Phase 3B had insufficient soil and vegetative cover. Erosion and exposed waste was observed
throughout this phase. See Observation Violations Section of this report.
5. The facility is currently working in Phase 4A. Facility staff started filling on the northeast end of the cell working
in a southwest direction.
6. Adequate cover was observed in the northeast end of Phase 4A.
7. The working face was small and compact.
8. No windblown waste was observed in Phase 4A.
9. Edge of waste markers were visible.
10. The facility had pulled two tires out of the working face and set aside to dispose of properly. Two tires were
observed in Phase 3B and pointed out to facility staff to remove.
11. A covered container is staged near the working face for the collection of scrap tires.
12. All access roads were maintained in good condition and the facility applies water to keep the dust down.
13. The facility is scheduled to mow the inactive areas in September/October.

Records Review
15. The facility accepts an average of 169 tons per day
16. Reviewed 1 st Semi-annual groundwater monitoring report for 2023, 2nd Semi-annual groundwater monitoring report
for 2023 and 1 st semi-annual groundwater monitoring report for 2024. Surface water monitoring is performed semi-
annually with their groundwater monitoring.
17. Reviewed methane monitoring reports for 3' Quarter 2023, 4th Quarter 2023, 1 st Quarter 2024, and 2nd Quarter
2024. Quarterly landfill gas monitoring is performed by Blue Flame LLC.
18. The facility provided documentation of weekly soil cover for their active filling in Phase 4A.
19. Random inspection reports were reviewed in the time period of Jan. 2, 2024, to July 5, 2024. Facility staff perform
one random inspection each day.
20. Certified Operators are as followed:

Jeannette Ramos - Certified Landfill Operations Specialist expired 2/10/2024. An extension was granted till
Aug. 21, 2024.
