CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(4)(a) states: "Owners or operators of MSWLF units shall ensure that: (i) the concentration of explosive gases generated by the facility does not exceed 25 percent of the lower explosive limit in on -site facility structures, excluding gas control or recovery system components; and (ii) the concentration of explosive gases does not exceed the lower explosive limit at the facility property boundary." On January 26, 2023, Rockingham County was in violation of 15A NCAC 13B .1624(a)(ii) for failing to ensure that concentration of explosive gases does not exceed the lower explosive limit at the facility property boundary. Landfill gas monitoring records show historical exceedances of methane at the boundary probes7901- M-3, 7901-M-4, 7901-M-5, 7901-M-8A, 7901-M-11 and 7901-M-12. The January 27, 2023, sampling event reported an exceedance in gas probe 7901-M-5; the level of methane detected was 47.7 percent by volume. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaNnent W Environnrenbl puelily Solid Waste Section During the inspection on July 24, 2024, the facility continues to perform corrective measures to lower the exceedances of methane at the landfill boundary probes. Kandice Estes stated that gas monitoring reports indicate that the methane levels continue to trend down at the boundary probes. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The permit for this facility includes the following operations: active MSW landfill, scrap tire collection, white goods collection and processing, compressed gas cylinder collection, electronics and TV collection, wood waste collection and processing, inert debris collection and processing, and a convenience center for the drop-off of residential wastes and single stream recyclable materials. 2. A landfill gas plant owned and operated by the county is located on the southeast side of the leachate pond. The plant is not currently producing electricity, and all gas is routed to the flare. 3. Facility Permit to Operate and Operations Plan are kept on site in the maintenance building. 4. Facility monthly tonnage records are stored in the facility office and were provided for review. 5. Proper signage was observed at the facility entrance. 6. Facility access roadways are of all-weather construction and in good condition. 7. The facility was observed to be clean and well maintained. Windblown litter was observed to be minimal. 8. Electronics and televisions are collected on a concrete pad located on the southwest side of the convenience area. Electronics are sorted, packaged, and palletized for transport. Loaded pallets are stored on a covered pad next to the drop-off location. The electronics collection area was observed to be clean and well organized. 9. Scrap tires are collected and stored on a concrete pad in a large pile located West of the maintenance building. The scrap tires are stored uncovered and are loaded into trailers provided by New River Tire. During the inspection a sweeper was observed cleaning the scrap tire storage area. Per 15A NCAC 13B .1107(2)(c) ensure that whole and partial scrap tires capable of holding water are covered upon receipt with a water shedding material or disposed of, processed, or removed from the site within ten days of receipt. 10. The white goods collection area is located on a gravel area and was observed to be in good condition and well organized. 11. The wood waste operations area appeared to be in good condition. No unacceptable material was observed in the wood waste stockpile. 12. The leachate pond appeared to be in good condition with adequate freeboard. The area surrounding the pond was well -maintained, and the visible portion of the liner appeared to be intact. 13. Landfill side slopes were observed to be in good condition with established vegetation covering the inactive areas. No trees or woody vegetative growth was observed at the time of the inspection. 14. No evidence of seeps was observed during the inspection. 15. The working face was well defined and observed to be small enough to be manageable by the operators on duty. No unacceptable materials were found in the working face.
