December 13, 2022 - Permit to Construct 7803-LCID-2022 4 Acre expansion; Permit to Operate current 3 Acre LCID (this was reissued to address wording and some issues with 3/17/2022 PTC/PTO.) ADDITIONAL COMMENTS
1. The purpose of this visit was to do a follow-up inspection of the Robeson County Landfills and corrective actions previously identified. Also, this visit was to introduce permit engineer assigned to Robeson County, with the Section, James Wallace, and the Hydrogeologist, Ben Kelly, assigned to the Robeson County Landfill, to the county staff. Their contact is as follows: James Wallace - (919) 707-8242 or james.wallace@deq.nc.gov; Ben Kelly - (919) 707-8327 or benjamin.kelly@deq.nc.gov. Mr. Walters explained the process to begin construction is moving forward with LCID. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres. An extension of 45 days was given, and that time was not met before this inspection was conducted. In addition, since that visit, and before the extension expired, another 45 days was requested by Robeson County to continue improving and working on corrective actions onsite. That request was granted, which would be a compliance dated 9/2/2024 for addressing previously identified violations.
2. The LCID working face was large but under one acre, with much waste to compact and cover. No visible unapproved wastes were visible and there was an attendant present, good job.
3. Older areas, such as the north half of LCID, still have exposed waste in some areas. These areas need appropriate cover, stabilized, and perennial vegetation established if not going to have waste within 3 months, per rule. Please address accordingly. A perimeter road has been added, good job. Although this access has been added, all weather access conditions should be maintained. EOW markers were visible around most of the LCID, but some are needed, one should be visible to the next. Mowing in some areas is also needed.
Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further

4. Corrective measures are necessary as a result of this inspection and should be completed by September 2, 2024. Failure to bring the site into compliance may result in further enforcement actions up to and including a compliance order with penalties.
