Good morning, Jason.
The responsible party attempted to collect a soil sample from near the failing spill bucket
in 2022, but no sample could be obtained due to the presence of pea gravel. Groundwater
(GW) sampling results indicate that contaminant concentrations have either decreased or
remained stable since the detection of the failing spill bucket and subsequent repair.
Based on these findings and Avery’s opinion, no additional site check is required for the
spill bucket’s failing test in 2022.
However, if any contaminant is detected significantly higher than previous results or if any
component of the system fails during the tightness test after incident closure, a new site
check must be conducted.

We aren’t the ones to decide if a site check has been done correctly and we don’t interpret results so I don’t know
what he was doing.

I can’t decide that.

Yes, I received the attached email records from the consultant.
Initially, the consultant proposed sampling the monitoring well (MW) closest to the failing
spill bucket, but Avery did not accept this proposal. After the spill bucket was repaired
and re-tested on June 10, 2022, the consultant conducted soil borings adjacent to the
spill buckets on July 27, 2022. However, no soil samples were collected due to the
presence of pea gravel. They then suggested installing a monitoring well.
I contacted Avery to confirm whether he accepted the soil boring situation and
groundwater monitoring at the site. Avery indicated that their work had met his
requirements for a site check investigation. I relayed Avery’s response to the consultant.

Because two oAsite water supply wells within 1000 feet were abandoned and no gross
contaminant levels (GCLs) were detected for any contaminants at the site, the site was
ranked as low risk. As a result, a notice of no further action was issued for site closure.
I have attached the email chain and the latest groundwater sampling results for your
information. If you have questions, please let me know.

My question is…is the area that was out of compliance in 2022 covered by the assessment that took place at the
site? Was it in the same area? If not another Site Check is warranted. If it is in the same area, then the Site Check is
not needed.

NORR was issued after receiving and reviewing the SCH report of 5/5/2019. I did not
received any other SCH.
Assessments have been conducted. CSA was completed and monitoring has been
conducted for a few years. After oA-site water supply wells were abandoned, the site was
ranked low, and NFA has been issued.

Jason Chapple with PIB is asking about the Family Fare BP located at 4839 W. Wendover Ave in Jamestown (see
email below). I saw that you are the incident manager for the release that occurred back in 2019 at this site. And it
looks like that one is still active. Do you have record of a site check for the two spill buckets back in 2022? Would a
Site Check be necessary or do you think this would be comingled with the current work that is being done?

Hi Ashley and Gene,
EMS was tasked with doing a site check for the regular and unleaded spill buckets at the referenced
facility. Soil borings advanced adjacent to the spill buckets on July 27, 2022 resulted in no soil
samples being collected due to the presence of pea gravel. The next step would have been the
installation of a groundwater well to assess groundwater quality.
The site is an ongoing UST investigation Incident #45216 with multiple groundwater monitoring wells
located near the UST basin and downgradient. The results of groundwater samples collected on June
1, 2022 did not significantly differ from historical values indicating a new release did not occur. The
groundwater sample event occurred after the buckets failed the test on 2/11/2022 and before the
repaired spill buckets were re-tested on 6/10/2022. See attached UST-17A and UST 23A from Jones
and Frank Petroleum Group.
Based on the current investigation of dissolved phase petroleum hydrocarbons at the site, recent
groundwater sample event in June 2022 between suspected release and repair dates, and the
presence of pea gravel in the UST basin adjacent to the spill buckets, EMS did not plan on preparing
a formal site check report. Let me know if that is OK in this instance.

Mr. Waring,
What would you like EMS to do? Soil samples were not obtainable within the UST basin proper
adjacent to the spill buckets due to the presence of pea gravel. The next step is to perform an
assessment of the groundwater as close to and downgradient of the spill buckets. The
current/ongoing groundwater investigation has wells placed in locations adjacent to and
downgradient of the UST basin. MW-1 was installed in 2019 to satisfy the requirements for a site
check around the regular spill bucket and resulted in the current UST Incident #45216.
It is unclear what you would have EMS do on behalf of M.M. Fowler to satisfy the requirements in
this instance. Please advise. Thank you

Hi Avery,
EMS was requested to perform a site check at the above referenced facility on July 11, 2022 by
Jones and Frank Petroleum Group. The request was based on your June 27, 2022 NOV
correspondence regarding the regular and premium spill buckets which had failed hydrostatic
testing in February 2022. EMS mobilized to the site on July 27, 2022 and advanced a soil boring
adjacent to each spill bucket. No soil samples could be collected since pea gravel was encountered
as was the case during a 2019 site check.
The site is currently under investigation for a confirmed release in 2019 discovered during the
performance of an earlier site check. The NCDEQ incident number is WS-10057 – 45216 and is
currently in a Pre-CAP monitoring stage. A total of nine monitoring wells have been installed on site
that were most recently sampled on June 1, 2022. A Pre-CAP Groundwater Monitoring Report was
prepared and submitted on June 17, 2022 to Mr. Gene Mao with the Guilford County DHHS. The
results of the groundwater sampling event did not differ significantly from historical sample events
indicating that there was unlikely an additional release at the site. I have attached a copy of the
report for your review and records.
