The Original Yard Waste Notification was submitted to the Section on November 3, 1993. The most recent renewal was
received on June 27, 2016.
The YWN was identified to be located on top of the pre -regulatory landfill, Gaston Refuse Disposal (NONCD0000475).
PURPOSE OF SITE VISIT:
Follow-up Compliance Inspection
STATUS OF PAST VIOLATIONS
A. 15A NCAC 13B .1402 (g) (1)(D), "the facility shall not be located over a closed -out disposal site."
UNRESOLVED, CORRECTIVE ACTIONS IN PROGRESS: As identified in previous inspection reports, the
facility is located on the top of the Pre -Regulatory Landfill (PRLF) #NONCD0000475. A yard waste notification
cannot be over a closed -out landfill, such as a PRLF. The Section is aware that the PRLF has undergone the first
phase of an evaluation. Based on the evaluation report, the majority of the yard waste is located on top of the waste
disposal area of the PRLF. As stated in the previous inspection report and technical assistance meetings, all
waste must be removed from the facility with no disturbance to the top of the PRLF. The Town is in the
process of removing the waste from the top of the PRLF. The Town submitted photographs and weigh tickets for
the waste that has been removed from the facility on July 11, 2024.

B. 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive,"
UNRESOLVED, CORRECTIVE ACTIONS IN PROGRESS: The Town is in the process of removing the waste
from the top of the PRLF. Continue to remove and properly dispose of the waste from the site. It appears that
additional unacceptable wastes have been uncovered during the removal the yard waste. Continue to remove and
properly dispose of the waste from the site.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is secured by a locking cable with fencing along Porch Drive.
2. A sign identifying the yard waste facility with a phone number was identified at the gate.
3. No additional wastes had been added to the facility since the last inspection.
4. No areas of standing water were observed, and the area was sloped to properly shed water.
5. Digital photographs were taken during the inspection.
6. Corrective actions are required as a result of this inspection report.
