PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The landfill is for private use and not open to the public. 2. A gate was located at the entrance to the facility. The gate was grown over with vegetation upon arrival. Please remove all vegetation from the gate to ensure it can be closed to prevent unauthorized access. 3. The facility had proper signage. 4. The access road leading to the landfill was of all-weather construction and well maintained. 5. The landfill appeared approximately 2-acres in size at the time of inspection. 6. Stationary markers consisting of PVC pipe were located on the east and south side of the landfill. However, additional markers are needed along the northern perimeter and western perimeters of the landfill to ensure the entire footprint of the waste area is delineated. 7. Majority of the landfill was covered with soil at the time of inspection with the exception of a small pile of landscape debris at the top of the slope. Exposed logs and stumps were also observed at the toe of the slope. Please ensure all exposed waste is covered with six inches of soil. As a reminder, 15 North Carolina Administrative Code 13B .0566(3) requires that all waste be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. 8. No erosion and sedimentation control measures were observed on site. Measures must be provided and maintained during operations or until the entire site has been stabilized with a groundcover sufficient to restrain erosion. It appeared the site had been seeded in the past with good germination of seed. However, the cover was not sufficient to restrain erosion as evidenced by some areas of sparsely covered or bare soil and slope erosion. Please reinstall erosion and sedimentation control measures as necessary to prevent silt from leaving the site. During the inspection, multiple pieces of a perforated carboard-like material were observed on top of the soil near the crest of the slope of the landfill. Please ensure this material is removed and properly disposed of at a facility permitted by the Division of Waste Management. No other unacceptable waste streams were observed on site. It appeared that all required setbacks were being maintained. 11. -acres in size must be closed in accordance with 15A NCAC 13B .0567(b) no later than January 1, 2026, or file an application for a permit from the Solid Waste Section for any operations of the landfill past that date. The permit application may be filed at any time prior to January 1, 2026. Mr. Shew was contacted by phone on July 18, 2024 in order to discuss future operations of the facility. Mr. Shew confirmed his plans to pursue a permit for the facility in order to operate beyond January 1, 2026. Mr. Shew stated his consultant was in the process of collecting all required information in order to submit the permit application.
