Shackelford, NCDENR — Solid Waste Section Andrew Holland, Anderson Creek Supervisor David Pemberton, Transfer and Landfill Operator David Baker, Transfer and Landfill Operator STATUS OF PERMIT: Closure of Anderson Creek Sanitary Landfill — March 19, 1996 Permit to operate C & D unit issued - April 17, 1997 (expired) PURPOSE OF AUDIT: Comprehensive Audit NOTICE OF VIOLATIONS: None You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 2 of 2 STATUS OF PAST NOTED VIOLATIONS: The January 14, 2004 Notice of Violations has been Resolved. 1. Permit Condition Number 5 — Resolved 2. 15A NCAC 13B .0505 (3) (b) —Resolved 3. 15A NCAC 13B .0505 (6) (b) —Resolved 4. 15A NCAC 13B .0505 (12) (b) —Resolved The May 24, 2004 Notice of Violation citing NCAC 13B .0505 (7)(c) has been Resolved. OTHER COMMENTS /SUGGESTIONS: , 1. 15A NCAC 13B .0505 (1) (a) states that "Construction plans shall be approved and followed. The soil stockpiles and grading that is occurring adjacent to the Construction and Demolition Landfill has not been approved. The permit and operational plan needs to be revised to include this activity and the permit renewed. Corrective actions need to continue. 2. I am in receipt of the August 12, 2003 letter written to Jim Barber concerning the renewal of this permit. Efforts to renew this permit need to continue. 3. NCAC 13B .0505 (2)(b) Spreading and Compacting Requirements states "Solid waste shall be compacted as densely as practical into cells." Additional means, other than a dozer, are needed to properly compact the waste. 4. The scrap tires are being pulled from the waste. 5. The wind blown waste around the landfill has been picked up as previously noted. 6. A sedimentation riser type basin has been installed to filter runoff from the borrow area. 7. A Comprehensive Audit was performed today. Employee training records, Contingency plan, and waste screening records were reviewed. 8. The Leachate breakout was repaired and a berm has been constructed along the toe of the Landfill to outline the boundaries. 9.
