Shackelford, NCDENR — Solid Waste Section Jim Barber, Permitting Branch Head Ellen Lorscheider, NCDENR — Solid Waste Section Andrew Holland, Anderson Creek Supervisor STATUS OF PERMIT: Closure of Anderson Creek Sanitary Landfill — March 19, 1996 Permit to operate C & D unit issued - April 17, 1997 (expired) PURPOSE OF AUDIT: Partial Audit NOTICE OF VIOLATIONS: AM NCAC 13B .0505 (7)(c) states that "Leachate shall be contained on site or treated prior to discharge." There was an area below the C&D unit that was discharging leachate into the sediment pond. The breakout needs to be sealed off and the upstream slope provided with a minimum of 1 foot of intermediate cover. Corrective actions need to be completed within 14 day s from receipt of this Notice of Violation. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 2 of 2 STATUS OF PAST NOTED VIOLATIONS: The Notice of Violation issued on January 14, 2004 is unresolved. The Notice of Violations 30 day deadline was March 3, 2004. Corrective actions have not been completed and the deadline has passed. OTHER COMMENTS /SUGGESTIONS: 15A NCAC 13B .0505 (1) (a) states that "Construction plans shall be approved and followed. The soil stockpiles and grading that is occurring adjacent to the Construction and Demolition Landfill has not been approved. The permit and operational plan needs to be revised to include this activity and the permit renewed. Corrective actions need to continue. 2. I am in receipt of the August 12, 2003 letter written to Jim Barber concerning the renewal of this permit. Efforts to renew this permit need to continue. 3. There were many scrap tires in the landfill. The tires need to be removed from the waste as they are noticed. 4. The wind blown waste around the landfill needs to be picked up and returned to the working face. 5. Adequate sedimentation and erosion control measures need to be practiced at the facility. Disturbed areas need to be provided with a ground cover sufficient to restrain erosion within 15 days between any phase of grading. 6. The Notice of Violation issued January 14, 2004 has not been resolved. The Violations listed on the January 14, 2004 Audit Report need to be corrected within 14 days of receipt of this Notice of Violation to avoid further enforcement actions.
